What about the Kids??

My wife and I are both British Citizens and hold British passports, both of us were born in Zambia and Rhodesia respectively and obtained our citizenship due to our parents having been born in UK. My wife lived and worked in UK for about two years and I lived and worked there for one year prior to us meeting. We subsequently met in South Africa where we married and now have twins. when they were born (21 months ago) we applied for SA passports for them. We are now emigrating to UK and need to know the procedure as far as the kids are concerned. Can anyone give us any advice????

Unfortunately, if you are both British citizens "by descent", then I believe that your children, born overseas, are not automatically British. You may apply for settlement (14.3) visas for them. After three years in the UK, they may apply to register as British (3(5)). Worth noting that registration as a British citizen under section 3(5) of the Act gives British citizenship otherwise than by descent.

It might be possible to get children British citizenship under section 3(1) of the Act after less than 3 years in the U.K. but this would give British citizenship by descent.
