English test

Hi there I am currently on Tier 2 visa with current application to switch employer applied last March 2017. I received a letter that the company is retracting their offer and withdrawing their sponsorship due to the delay in processing my new visa. Can I use my English test for my Tier 2 Visa if I want to apply as a spouse visa this time? Me and my partner are getting married by November , I have not received a letter of curtailment , will it be a problem to marry him as I have no pending application as I resigned from my last job last March 2017? As Non-Eu needs to give a 70 days for a notice to marry. Pls help me with this. Thanks in advance .
