Hello I am British citizen and I have a baby with my partner who is illegal and application pending for leave to remain

If I declare him as living together to the benefits will I still receive my benefits he is currently not working I am on 16 hour contract when I return to work after my maternity leave

You must declare it if you are living with a partner. Not doing so is benefit fraud as you are NOT a single parent.

Presumably your partner has applied FLR(FP) PARTNER route. If so, HO do check all the benefit authorities.

Thank you for your reply I have never claimed benefits before so it's all new to me I have now declared him so hopefully all should be ok and will I still receive money?

Do you no if I make a application to homeless and I say for him they will still have a duty to me ?

And on the forms where it says is your partner under immigration control do I answer yes if he has a application pending ? I'm not sure what I answer

The answer to your question is yes. He's still under immigration control even if you have just make an application to the HO.
