5 year Cap/Academic Progression

Hi Im jeremy. I have a similar case but little bit diff.

I'm an international student. I applied UK study visa starting from Sept 2013 to Aug 2016 but I didn't manage to finish my studies as I failed one of the subjects in my second year. I able to repeat the subject again with additional few subject of my final third year. However, I didn't pass again this time due to some family financial problem.

Therefore, I only able to graduate with CERTHE certificate ( completion of one year ) as I didn't complete my second year due to one subject. I went back to my home country as solving some family problems and trying to apply into other university again with year two entry this time now. I have offers but the university unable to proceed my CAS application due to previous academic progression I have studied.

Now, I tried to clear this matter but the university insist that it cant be helped although my family and related party willing to provide informations needed to justify my situation.

AND, I'm actually applying the visa application from the outside of UK as im international student. Does academic progression will still be exempted in this case ?

Yes. It is worth checking that the university understands you will be applying at home, not in the UK.

If they still have an issue, it may be about your general credibility, but they should explain that to you properly.

I advise you ask them exactly what aspect of the Tier 4 eligibility they think you will fall foul of. If it is academic progression, they have misunderstood the rules. If it is credibility, ask them to explain their concerns.

Alright thanks for replying with such confidence :) As far from what I know, I haven't told the University that I'm applying UK visa from the outside of the UK so your explanation might be the possible answer that can help to solve my issue here.

Here is the reply I got from the one of the Universities I applied;

We do not consider your application to show academic progression for the following reason:

· You have previously studied in the UK on a course at the same level applied for. To show genuine academic progression: you must be able to sow that your chosen course is a genuine specialisation based on previous study through your written Statement of Purpose and education history combined, or is indeed at a higher level of study than that previously. Each university will assess such individually and independently, but sadly the University does not consider you to have evidenced this and will therefore not be able to progress your application further.

Would you mind help me check based on your opinion that the explanation means academic progression or other aspects of Tier 4 eligibility? I have sent an email to them and hopefully I will get a reply asap.

Thanks again. I'm still waiting for the reply. However, I have another question. Although I'm applying overseas, but I have studied in UK and I'm applying the same course in order to complete my final year but different university. Am I still able to be exempted from academic progression? That's my main concern.

Yes, I have looked on the part you highlighted to me. Although it says the visa is applied from overseas then academic progression will be exempted, but how about this one. I have here it states that 'If you are an offer-holder, your Admissions team will usually become aware of your previous UK-based study after you have submitted a CAS request online'. Is it only apply if I applied within UK?

I have read all the paragraphs on how it affects me. Eventhough I have read them, it seemed like I'm still will not be exempted if I have studied in UK previously. Also, note that I'm only using CERTHE certificate (one year completion) from my previous UK study qualification, which supposed to complete my degree that time. Or I have read them wrongly that they still have to follow the exemption rule despite I failed to show academic progression in my previous study in UK.

Hey guys ,
I'm have applied for same level course , I have a taught masters from UK but this time I applied for master of research bcuz I am aiming to do PHD . The university did give me an offer although it's the same level as my previous qualification but I didn't know you are exempt from academic progression of you apply outside uk so I never mentioned that to uni. The university did write a academic progression statement on my CAS ". The university confirms academic progression" but I'm worried of such a short statement is enough to justify my reason for doing the same level , bcuz it doesn't really explain why I doing same level course and I tried to explain that in my interview but interview was jus general questions ..
Am I worried for no reason if University confirms academic progression ? Or does the statement needs to be proper explaining academic progression in detail?
