Naturalization - Final year absence of 93 days --Urgent help

Post by Prasathc43 » Fri Aug 11, 2017 10:49 pm

Dear friends,
I meet all criteria except for the fact that on final year having absence of 93 days. If i need to apply within 90 days period, i need to wait for 3 months down the line. I booked the appointment in couple of days and going with 93 days absence during 14 Aug 2016 to 14 Aug 2017. I went for personal trip and not business.

I see that in Naturalization guidance document, the following point is mentioned
Total number of absences normally disregarded 100 days.

How ever in naturalization application form, where and how do i mention about this that i am requesting for this special discretion to be applied. The closest match i can see is in section 7.7 (see below) . Can i declare that in ? Pls help me... Any suggestions would be greatly appreciated.

7.7 *I declare that, although I do not meet all of the statutory requirements for
naturalisation, I believe that, in view of the following special circumstances, the
Home Secretary should treat me as fulfilling those requirements or waive the need
in my case to fulfil them.
*Delete if not applicable
Special circumstances – which requirements do you think you fail to meet and what are the
special circumstances? If you do not meet the statutory requirements to become a British citizen
are there any special circumstances why you think the Home Secretary should still grant your
application? (continue on page 22 if necessary).

How about delaying the application by few months if that helps? Although, as mentioned in the guidance, they will not normally refuse your application on absences for few days over the limit.

Thank you so much for your reply. I would like to go ahead with the application as scheduled.
I have limited company in UK which runs for 5 years. I got my accountant letter mentioning profits and tax and turnover etc.

I am thinking of putting this info in page 22 section
=========
Please consider the application at the discretion for excessive absence of 3 days in final year w.r.t the guidance rule of "Total number of absences normally disregarded 100 days"
I have established my company in UK and been paying all taxes regularly.

Also i will attach Accountant letter with the application form. Shall i discard the 7.7 special circumstance section then? Please advise. I have also worked on 3 weeks Work from Home in India while i was on Holiday on final year. I think i cannot put that info anywhere .. as i cant get letter from client, as i was doing contracting through my limited company uk. But i have the invoice and amount credited from agency. I have even taken salary on the months while i was in india. Not sure if this is something will be useful? can i mention anything of this ? Please advise. Thanks a lot for your inputs in advance.

Can i put the 3 weeks i worked in India as business in absence ? I am a contractor working for my limited company. I have the respective timesheet and invoice and the amount credited in business bank account.
Can i attach these as proof?

I see the people who work in Permanent employer, get the letter from company saying the person on business travel for so and so date. For Person who is working through limited company .. who needs to certify this?

Accountant ? or Employment agency to which i have a contract or the End client ... Please share your thoughts and do u think if this can be put in as a valid proof?
