10 Years ILR. Shall I apply or wait?

Post by Confusedbuthopeful » Thu Aug 24, 2017 3:34 pm

Hi,
I came to UK as a student with my three year old little girl on 10th of September 2007.
I got extensions as PSW and then Tier 1 high skilled resident permit first in 2011 for two years until 2013, then for three years from 2013 to 2016. My visa was extended until July 2016. However I got married to a British citizen and switched to spouse visa in April 2016 as I left my job and couldn't show the required income. Now my 10 years in this country are nearly done along with my daughter. She has a dependent status. I also gave birth to a baby girl in Feb 2017 who has a British passport by birth.
I have one glitch however. I showed my regular income plus self-employment for my previous applications and have not paid tax on the extra income shown. Other than that, I have no gaps in my stay. I have lived here for ten years, my daughter is a regular student at school and an exceptional one. She goes to a Grammar school

Please advise whether I can apply for ILR using 10 years route or not.
Many thanks.

Sort out your unpaid tax first.

I've previously asked in the forum on my own post & unfortunately none replied. I've almost identical situation as yours, only difference is that I've sorted out the Tax Issue at the end of 2015 (only the initial application for Tier 1 General as the extension was purely on Employed Earnings). Current FLR (M) got until 2019. I would be eligible for 10 years Set (LR) in 1 week time but as you also asked the very question whether to apply or not & if done so, what should I be prepared for! My Spouse is British Citizen & we've a child who's also British+Irish Citizen & we're well settled here in the UK.... Would appreciate some thoughts on the matter.
