FLR(HO) Varying after marriage

Hi everyone,

Im very new to this. I have applied for my visa FLR (HRO) on the 6th of April. After a month I checked my status online it said "awaiting decision".

Now, after I got married in July and varied my application on the 16th of Aug, I tried to enter my caseID number (with and without the zero), reference number and the IHS number and it says "not recognized".

Does anybody know why this has happened?

What is your FULL immigration history in the UK?

What nationality is your spouse?

Hi everyone,

I have just received the decision from the HO saying that my application is unsuccessful. They have not given me a right of appeal. I thought they might give me a right of appeal as my wife is a British national. I have not been certified either but they have said :

"If you have reasons to stay in the United Kingdom that were not part of your recent application, you must state them. This requirement is being given under section 120 of the Nationality, Immigration and Asylum Act 2002. If you do not tell us as soon as reasonably practicable and you tell us later without good reason, you will lose any right of appeal you may have otherwise qualified for if we refuse your claim".

How do I respond to this? what more documents should I send and is there a specific form to fill?
They have not given me a deadline but I do want to respond as soon as possible.

What is your full UK immigration history?? You have not posted this information in any of your posts you have made on the forum.

What are the 'insurmountable obstacles' reasons you have used for FLR(FP)?

Did you get married in an HO approved Registry office, hindu ceremony, islamic marriage.....etc???

How long have you known your spouse?

How long have you been in the UK? Must be a few years if you have accrued £15k of debt and looking at doing a DRO

I have been in the UK for 10 years and 7months. I arrived to the UK in 2007 as a student. then after my degree i was granted the PSW. i applied for the FLR O in 2015 and got refused in 2016 jan, and then went through the JR route and was refused on jan 2017. I applied for FLR FP )partner route in april 2017.

Insurmountable obstacles were
1- wife's Skin condition. Got a letter from GP stating how dangerous it is for her when it comes in contact with sunlight which could lead to cancer.
2- her Mom's health condition (heart transplant) and she has to be here to take care of her.
3- her own business that involves only British manufacturers for nearly 10 years.
4- i dont speak read or write my own language as i was born and brought up in another country.
We provided evidence for each and every statement.

in the refusal they have not mentioned anything about our relation in term of it being not genuine or not subsisting.

It was an English wedding and yes we took permission from the HO before getting married. we got the approval from the HO in about 2 weeks

I think you have an arguable case.
Good chance of success but that's my opinion.but a long battle

Thank so for the reply.

But they have this section 120 which I tried to find out online what should I be doing and how? No idea what it means. It says:

Plus there are so many other statements they say I have claimed which I have never said or declared. All false!

With this refusal I have got no appeal but not certified. What is my next best option? And please do let me know what it means when they have given me "section 120"

You need to get advice from lawyer, we had 120
on removal notice ask to respond with in 10 day, and our lawyer was confident will got respond in 3 mths,but we never got any response,instead we was invented for meeting bad experience lol,and the lawyer keep saying not worry let wait reply of 120 time then we decided ignore the lawyer just fill another application of our child over 7 year and in two mths granted leave .our lawyer still waiting reply lol!

So once you sent the section 120 with additional information the called you for an interview?
What did they ask you?
Did you send the 120 within 10 days?

Hi meeting was for volunteer return as our application was refused with no right appeal , the meeting was about option if we can choose assists or on our own cost and the ban. So we didn't want to risk as our lawyer keep saying we shouldn't worry just wait the respond but things was getting hard they change repoting from mthly to every 2week and me and my partner at the the same time. In short we didn't get any response . You need a professional advice .

We did make another application for our over seven years child who now been granted.

Sorry for the late reply. Was preparing my sec 120 all this time and now its done and sent. Thanks alot for the information and glad that all is well with you.

hi there
iam here under spouse visa but the home office cancelled it as me and my wife are separated now
they gave me the right for Administrative Review and the served me one stop warning section 120 to tell them any reason or grounds I should be in the uk

I do have a British son who iam trying to sort out the contact between me and him through the court as my wife doesn't want to help in terms of seeing him so I have a hearing soon.

so if you let me know what is your solicitor done for your section 120 statement will be great
and I don't really know why they didn't ask me to fill a fresh FLR(FP) instead of just section 120?

if any one experience what should I do will be great if they can help?
I don't know what should I do to go with section 120 or am I allowed to fill a new FLR (FP) from with paid fees

the person who created the topic was asking if someone else has the same issue or served the same notice section 120 and was asking if any one wants to know what his lawyer done
that is why I explained what is my situation and waiting for his answer
I do have my own topic anyway
