Extended family members for uncle

Post by danieldf » Mon Aug 28, 2017 1:46 pm

Hello everyone, I am a brazilian citizen and went to uk some years ago and stayed for 6 months, after I came back to Brazil.
My sister has been living in the uk for 8 years and is married to a EU citizen from Portugal who has been living there for 6 years. But now they had a baby who is a UK citizen holding a british passport.
Now I would like to join them in the uk to live, work and also study. Is there a way for me to apply for extended family member visa through my nephew who is a british citizen?

Thank you in advance.

No there isn't. British citizens within the UK are excluded from sponsoring an extended family members or using the EEA/EU route applications.

Could you tell me if there is any way to get a visa to stay in uk through any of my family members?

No - only on your own merits, ie student visa (expensive), marriage visa (drastic) or work permit (unlikely).

Are you a dependent of your Portuguese brother-in-law or your sister (regular financial transfers, etc)?

If I move to uk yes, because I have nowhere to go

You would have to prove that you had been dependant as an extended EEA family member before moving to the UK.

Casa - is the requirement to prove 'part of same household as EU cit' prior to applying also a requirement?
