Work rights whilst in Judical review

Post by SamRaj » Sat Sep 02, 2017 2:01 pm

Hi Experts,

I am a dependent of Tier 1 holder and have been working for a company.

Now our Tier 1 extension visa got rejected after waiting 6 months. We have even applied AR and that too got rejected 3 days ago.So Now we are about to lodge JR in 2-3 days.

So my point is , if I am allowed to work whilst JR in process. Mean while , my HR has already done the employment right to work check 3 months ago while we were waiting for the decission from HO and it came up as positive.

Now I do not have any idea , what to do with my employer?
Please kindly advise with some sort of link/proof.

Thanks
Sam

Shall ask them to check again with HO once we lodge the

Which category of Tier 1 did you hold (yes, there is more than one sub category)? You have posted in the visa category Tier 1 GENERAL sub forum.

What was the reason for the refusals?

If your visas have expired, you do not have the right to work. You are now an overstayer.

Not necessarily. I suspect the OP mean Tier 1 Entrepreneur visa category.
