[URGENT] Long Residence (10 years) SET (LR) applications - Sponsor license's suspended

Hello everyone,

I have made a premium services appointment this month, but my case is becoming complicated as company's sponsor licence is suspended recently, I would like to know what will happen to my application in the following situation:

1. Currently on a Tier 2 visa in the UK valid until 2019.
2. Company’s licence suspended on 31st August 2017.
3. Company requested to make representations by 28th September 2017 (i.e. 20 working days from the date of the letter received).
4. Suspension of the company licence had nothing to do with me.
5. I can keep working during the suspension period.
6. I will be meeting “Living in the UK legally for 10 continuous years on 15th October 2017”.
7. I meet all other eligibility requirements.
8. I have a premium services appointment scheduled for 19th September 2017 (within 28 days of the applicant completing the qualifying period).

I understand that it’s not advisable to apply to extend a visa when the sponsorship licence is suspended as the application would be put on hold until the suspension ends. But I am unclear whether the same principle would apply in respect of ILR.

It appears that the requirement for 10 continuous years is on any legal basis. As I can keep working while the sponsor’s licence is suspended (pending investigation) and given that any future revocation would permit me a period of 60 days to remain in the country whilst looking for work, is it reasonable to assume that I should still be considered to be legally living in the UK? My assumption is that I should not be impacted whether the company’s licence is suspended and remains under investigation at the date of the appointment; any potential revocation would certainly not occur until a later date.

Would you recommend that I go ahead with the appointment on 19th September 2017? If so, are there any specific documents (specifically related to the suspension) you would recommend taking? If not, what would be your best practice advice for successfully getting granted ILR?

As this matter is urgent, I would appreciate a reply as soon as possible.

Thanks zimba88 for your advice. I am quite confident that I would not breach the conditions of my stay during the Company's licence suspension period, but the only concern is they might put my application on hold even if I am going for a premium service appointment (normally could get a result on the same day).

Is there any way or a cover letter I shall add on as an extra support document to avoid the application on hold? Otherwise, I might just cancel the appointment and wait for company's result, then reschedule an appointment afterwards.

It is up to the HO to decide whether your case is straightforward or needs further investigation. You cannot do anything to avoid that, you can just hope for the best

I saw a post regarding applying for ILR on 5 year Tier 2 General route, which needs to provide a letter from the employer for evidence of all work-related absences. just wondering if it applies to a Tier 2 visa holder but applying for 10-year long residence?

I'm on the same boat. My company licence just been suspended on 25th Oct 2017. And I've booked premium service on 10th Nov 2017 that's when my ten years completed. Let me know what will be the outcome of your application. I wish you all the best.

Hi guys,

Just updated the outcomes about today's premium appointment --- I have been approved ILR and the BRP card will be sent within 7 working days

What a story that the company's sponsor licence had been reinstated last week so my case is very straightforward.

I have submitted the following documents just in case if anyone would interested in:

• Two identical passport size photographs;
• Two passports (one current and one previous);
• One BRP card
• Two original police registration forms;
• Original degree certificate from a UK University;
• Original pass notification letter for ‘Life in the UK test’;
• Original letter from the employer;
• Original recent three months bank statement;
• Three original payslips;
• Three original P60 forms;
• One flight E-ticket (Exit/Other country’s entry Stamp was not stamped on the passport);
• Photocopies of all documents.

The highlighted part is essential but I provided others on the list as additional documents to make my application stronger. I also provided a cover letter stated my absence dates and stamp pages to help in the case processing quicker.

I will complete 10 years on 28 January 2018
So I can apply 28 in advance
But I am getting all kind of negative thoughts
What happen if my company’s license suspended ?

Not yet. As Hr team are still preparing all the required doc's as per HO letter. The deadline is 21 Nov. I'm keep my figure cross and hoping for the best.
I also took advise from my solicitor who has processed my Tier 2 application. According to him I will be fine as my name is not in HO letter and I m not in breach of Tier2 rules. Long residency is based on multiple visas and time spend in UK lawfully.
