Hi All

This is my first time post so do excuse me if I have missed any forum rules here. Let me know and I will amend.

I'm the British citizen spouse (married partner) of an applicant that came in from outside the EU.

We applied for a spouse visa and received it around 2.5 years ago and are now due for a renewal visa, or a visa to remain with a family member.

In the time that has passed since the first visa, some of our circumstances have changed. so we have a 3 month old baby girl, we have moved into an owned property and I am now working as a freelancer. Also my dad has been fighting with cancer so I haven't been as organised as last time and left things to the last minute.

We've just paid for a premium service and booked an appointment in another city in order to make it in time before the visa expires. That's in 3 weeks time (a week before the visa expires).

So because I'm freelancing, my salary has been around £3,000 for 2015/2016 and I've taken £20,000 in dividends. My accountant was so slow in submitting my accounts, I haven't been able to submit my self assessment yet. My wife also took around £6,000 in salary working for me but my salary and hers combined won't be enough without the dividends.

My daughter doesn't have a passport yet but she does have a British birth certificate. Also she was born in an NHS hospital and I was never asked for any money.

I have a few questions I was hoping someone here can help me with;
  1. Will I make it in time to meet the financial requirements and if the paperwork doesn't come in on time what should I do?
  • Would there be an NHS bill that I need to settle before applying?
  • Will my daughter be considered a dependent under the application and will I need to pay an extra fee for her?
  • My wife got a B1 for her general training IELTS three years ago so the certificate is expired. Will we be able to use the same certificate to re-apply for this VISA?
  • What do I need to show for owned property?
I appreciate any help provided here.

1. Not sure about that but you do need to meet the financial requirments. Submit your accounts and anything else you have like evidence of dividends etc, Wait for someone esle who might have more advice,

Your child is British and your spous has a valid visa, they are free to use the NHS without any charges,
Will my daughter be considered a dependent under the application and will I need to pay an extra fee for her?
A dependent yes but NOT for immigration purposes, ie not requiring a visa so no extra fee needed.

Title register, most recent mortgage statement, council tax

Thank you for the quick response CR001. I'm just concious about time. I don't know what will happen if the application gets refused :? will my wife have to leave to re-apply from abroad? That would be unsettling especially because my daughter doesn't have a passport to go with her.

My fault really for keeping it so late :cry:

Possible she will be issued with FLR(FP) 10 year partner route if not outright refused.

Spouse Visa FLR(M) Finances Company director

Hi

I am a freelancer working under my own limited company as the director and under PAYE. I have for 2015/2016 £3,000 in salary and £20,000 in dividends where I made around £50,000 in profits. My salary pretty much matches in terms of dates with my payslips. My dividends however don't and I'm pretty sure some of it still hasn't been paid into my account.

Do I understand correctly that I need to show my self assessment for 2015/2016 and the last most recent 6 months of payslips/statements? and under which category do I apply?

but most importantly I'm not clear on what I can produce to show I earn over £22,000. That's the required as well as what would help.

Your help is much appreciated
