Start Date of my Tier-2 General visa

Post by minggiano » Thu Sep 14, 2017 2:48 pm

Hi all,

I have a question regarding the start date of my visa and I think it is critical to my ILR application.

I was on my Tier-4 Student visa in 2012 and it was due to expire in Jan 2013. However I was lucky enough to be sponsored by my employer in Oct/Nov 2012 so I completed my online application for Tier-2 General Visa on 8-11-2012 and then provided my documents ...... by POST, which took me 5 months to get the result (Mar 2013).

In short, my case is:

Online application date: 8-11-2012
On the first BRP:
Date of issue is 07-03-2013
Valid until is 16-11-2015
And I renewed my visa in 2015, on the new BRP:
Date of issue is 09-10-2015
Valid until is 14-11-2018

To me I have the feeling that the "start date" of my visa is 8-11-2013 as it looks like the total of the first visa is 3 years (from 8-11-2012 to 16-11-2015) but I wonder if actually it is the date of issue that counts as the start date of my visa. May I know your opinions please? It really affects if I can apply for my ILR this year or not ...

Thanks very much for your reply in advance.

Ming

Your Tier 2 visa start date is 7th March 2013 and not the date you applied online.

Not sure you have posted your dates correctly as they don't make sense.

Thanks for your reply ... there's a typo and I was saying 8-11-2012 not 8-11-2013. Is this part doesn't make sense ... ?

I don't know why but I remember when I was renewing my visa in 2015 a staff told me the start date is in Nov 2012 and I was really confused ...

No, it is definitely the date your Tier 2 was issued and not the date of application.

At the time of your visa application, you were on Tier 4 and those conditions continued until your Tier 2 was issued. Tier 4 time is not eligible for ILR under the 5 year route.

Thanks a lot.

I know tier-4 doesn't count under the 5 year route.

Then there comes something weird .... because I said I got the date of issue of my first BRP is 07-03-2013. However actually there's one more BRP they gave me in which the date of issue is 21-02-2013, but I posted it back to them because they printed a wrong place of birth on the card and that's why they posted a new one to me (07-03-2013). It makes me think it's actually the date of issue is referring to the card, not the identity. Am I right?

I might have lost the letter for the first application. However on the letter of the visa renewal there's also no such thing like approval date ...

:(

Yes I am aware the letters don't state much. However, the letter itself would have a date on that it was printed and sent to you.
