Tier 2 General PBS Dependant extension on FLR(M) after my ILR

Post by abin001 » Thu Sep 07, 2017 2:33 pm

Hi,

I came to UK under Tier 2 (General) VISA on August 2012. Now completed 5 years and time to process ILR application.

I'm living with my wife and 2 kids here. My wife and 1 child came to UK 8 months after I came and second child born in UK. They all are under PBS Dependant VISA.

What type of VISA they can apply to remain in UK without a Sponsor? OR Will UKBA accept if my current sponsor provide maintenance letter to them? OR what I can do to let them remain?

My second child can apply for Naturalisation?

Thanks

What type of VISA they can apply to remain in UK without a Sponsor?

Extension of their PBS dependent visa. They are NOT dependent on YOUR sponsor/employer. They are dependent on YOU.
OR Will UKBA accept if my current sponsor provide maintenance letter to them?
Probably not.
OR what I can do to let them remain?
PBS dependent extension.
My second child can apply for Naturalisation?
Children are REGISTERED as British. UK born child can be registered once you have ILR.

Have you read the guidance notes?

Same requirements as when she applied or extended it before.

If you don't meet the maintenance requirement, the extension is likely to fail. You need to show maintenance for wife and child born abroad.

When do their visas expire?

If you don't have the required maintenance in the UK or a bank account abroad (in either name), she can apply for FLR(M) once your ILR is successful and you meet all the requirements. English A1 will be needed for your spouse and switching to FLR(M) will reset her clock to zero and a new 5 year residence requirement (2 x 2.5 year visas) before she will qualify for ILR, this includes your child born abroad too.

Your UK born child does not require ILR or FLR(M) if you plan on registering the child as British once you get ILR.

One form for both of them together. Wife main applicant and child as dependent.

Do you meet the financial requirement?

Your wife will also need to meet the English requirement.

Do this application (FLR (M)) need financial requirements?
Yes. You need to prove that you meet the £22,400pa financial requirment with evidence of at least 6 months and 6 bank statements.

Have you booked her English test at an HO approved test provider?

Please ask your citizenship questions for your children in the British Citizenship sub forum further down the main forum page.

I will also move this topic to the Family Immigration sub forum as you are switching your spouse to FLR(M).

You have clearly not read the entire form. Read page 64.
And what is "Letter from your and / or your sponsor’s employer/s"?
To meet the financial requirement, you need a letter from the employer stating your employment details. This is not the same as the contract of employment.

I have read page 64 and now I understood. Of course your guidance is appreciable.

I have a doubt in Section 2.

FLR (M) is going to apply due not enough fund maintained in last 90 days for the Tier 2 PBS Dependant extn requirements.
In may case what to select in 2.1, 2.2 & 2.3

(I have many doubts in each sections in upcoming messages, please don't hesitate to reply as what you do now)

Thanks

Hi,

I have got my ILR and now my family applied for FLR (M) Visa by post and they have taken their biometrics on 09-10-2017.

Do you know the processing time after the Biometrics? AND
Is any other option to speed up the FLR (M) application? I mean, Could the Application to transfer a standard route (postal) application to premium service?

I found, for SET (M,O,LR,AF,F & NTL (No Time Limit)) applicants can do these services through the Visa premium upgrade request (https://www.gov.uk/government/publicati ... quest-form).

Thanks

No, you will need to wait. It can take 8 weeks or longer.

This only applies to ILR applications and not FLR(M).

For FLR documentation I have provided my present company employer letter.

Now I wish to resign from the company. Does it affect the VISA processing?

Thanks.
