Need advice

Post by andyferns » Mon Sep 18, 2017 1:34 pm

I have a Tier 2 general visa valid till Oct 18 and a CoS till Oct 18. However, I had a fall out with the employer and had to resign with immediate consideration. Now i have 60 days to search a new job.
Wanted to check, can the CoS be transfered to the new employer. What if I land a job and the process of transfer or new visa is in process. Will I be allowed to be in the country.

No. For a new employer, you need a new CoS after RLMT is done and you have to apply for a new visa.

Yes. However you should note that an employment gap of 60 days or more between last day of employment and new visa application date means you will likely not qualify for ILR.

I am not looking to apply for ILR. Rather needed to understand if the new Tier 2 visa process is applied will i be allowed to stay back even after the 60 days period.

Yes. It takes a few months for the curtailment letter to be sent by HO.

You should not travel outside the UK though and obviously you are not allowed to work until you have a new visa.

The reason I mentioned the 60 days gap is most Tier 2 General migrants aim to apply after 5 years in the UK. If you plan on leaving the UK, then no issue.
