!!!Very Urgent-->Applied for FLR(M) by mistake

Dear Gurus,

My wife moved to the UK on 3rd Sep 2014 on a Tier 1 Dependent visa valid till Sep 13th, 2017. I got my ILR in April 2015. On 5th Sep 2017, we have booked in premium service appointment for an extension under FLR(M) category. The caseworker on the day asking for some additional documentation to be posted ASAP suggested that we should've applied for an extension under PBS dependent category as it costs less and it is an easier route to secure an extension. After going through the forums here I realized :oops: that PBS dependent visa is the appropriate route through which my wife can secure an ILR. Given the fact that my wife stayed in the country for 3 years, and I don't want to reset the ILR clock, would it be wise for me to withdraw her FLR (M) application(as its still under consideration) and freshly apply for a PBS dependent from India as her visa has already expired on 13th September 2017? Doing this would create a gap of at least 2 months in her visa continuity, can someone suggest if this really impacts her ILR eligibility? Can she apply for PBS Dependent extension from India?

Looking forward to valuable suggestions from the members.

Normally an application can be varied to a different category while pending.
But in you particular circumstances as it's a premium service I don't know if you can vary it to pbs dependent .
Wait for some senior to come a shed some light on it .

On what basis did you get ILR, 5 years PBS route or 10 years long residence?

Hi There, Thanks for the prompt response. I got my ILR through 5 years Tier 1(PBS Route).

I am not sure how you can fix this now as you have already attended the appointment. Perhaps complete Tier 1 Dependent form and request if the caseworker can consider that instead.
