Refusal risks

Post by majid994 » Thu Sep 28, 2017 11:08 am

Hi, I have recently got my ILR based on T1 Entr 5 years route .

I understand that there is a 12 months that I need to wait to apply for citizenship however I believe there is a discretion to disregard this based on the caseworker’s decision.

My question is that if I apply and get refused, will I be able to apply again next year? Or do I get penalised for that?

I don’t mind losing the money as benefits of having a British passport is significantly beneficial for my business.

Please advise

Thanks

Only in rare/certain cases of severe delays for ILR outcome (15 months or more) through no fault of the applicant. Yours not being one of these cases as you applied in July 2017 and got ILR in September 2017.
My question is that if I apply and get refused, will I be able to apply again next year? Or do I get penalised for that?
You can apply whenever again, your choice if you want to waste money now on an application that will be refused.

It does not make sense applying knowing fully well you will be rejected. Just wait till after 12 months then you can apply. This wont look good on your history as the Case worker will feel definitely you do not want to be in the UK after you gain citizenship or there is a motive for you want to apply before your qualifying period. I am 101% sure it will be refused.
