Unusual CSI question. EEA national and American wife who is staring university

Hello,

I am an EU national (Polish) and my wife is American. My wife currently holds UK Residence Card based on being EEA family member (my wife). I have a full time job and until now my wife also had a full time job. She is starting one year Masters course at a university next week and we have been wondering if she is required to hold Comprehensive Sick Insurance or if it is sufficient that she is my wife and I have a full time job and am paying taxes.

I have my self tripped up on not having CSI while I was studying, and thus had to wait additional 2 years after my studies have concluded before applying for EEA PR (it has been two months and I am still waiting). We are basically trying to avoid any future legal troubles for my wife.

Many thanks for your answer. Just to clarify, you are saying that she does not need CSI because I, her husband, am a full time worker paying taxes. Is that correct?

Correct. You, as the EU citizen, must be the qualified person, not your wife. She can choose to study, work or not work and it makes no difference as long as you are qualified and exercising treaty rights.
