Can I apply Citizenship for my son who bron in India?

Post by 27sumit » Sun Oct 01, 2017 12:43 pm

hey,
i am in similar situation as you. kid born outside country in 2010. got my ilr on 2nd oct 2016, my wife got ilr 28th sept 2017.
now thinking whether i could apply for citizenship for my kid with myself without having to pay fee for ilr for my kid.

but in your case, i guess chances are somewhat more bleak as least both parents needs to be ilr if not citizen.
so get ilr of your wife first i will reckon.
thanks

Your child also requires ILR as you were already advised in your previous topic asking the same question in May 2017 (click). Why did you not apply for the child ILR when the mother applied?

Also, kindly start your own topic with your questions.

Advise on child registration as citizen without going through ilr process

Post by 27sumit » Sun Oct 01, 2017 1:21 pm

hello there,
got my ilr in oct 2016, wife got it in sept 2017. kid born outside UK and is living as tier 1 dependent in the UK for last 6 years.
as it is a matter of 2300ish £ which I was looking to save somehow if kid for be directly registered as citizen when i apply for citizenship this october.
is that a possibility or is this something all discretionary and not officially document?
thanks,

High rate of refusal as the rules clearly state that the child must be 'free from immigration time restrictions (ILR)'.

You should have applied for your child with your spouse. You risk his current visa expiry and then you have bigger problems.

hey sorry to bother you again,
so if i give it a try by applying for my kid direct registration (without ilr) with myself as a family application, and if kid's application get refused, can i still apply for ilr for kid thereafter? his visa expires in feb 2018. so question also was if his application gets refused post feb 2018, will his ilr application be considered or will he be considered an overstayer?
thanks

You can try, if refused you will lose the almost £1000 fee.

If a refusal decision comes after his visa expires, he will be an overstayer.

Referee profession in citizenship application

Post by 27sumit » Mon Oct 09, 2017 5:31 pm

Hi there,
One of the requirement in citizenship form is as follows:

"5.1 One referee should be a person of any nationality who has professional standing, such as
a minister of religion, civil servant, or a member of a professional body such as an accountant or
solicitor (who is not representing you with this application). The other referee must normally be the
holder of a British citizen passport and either a professional person or over the age of 25."

Can you kindly let me know if there is a list of professions to choose , which if one have can be considered as a referee?
I have teacher in mind who knows me for 5 odd year and teaches in counil school if that helps.
many thanks
Sumit
