Moving from Tier 2 General to Spousal Visa

Hi Guys,

Firstly, would like to say hello to you all, great forum, I have tried to read a number of threads to find a solution first but couldn't find anything recent, so hope it is OK to post this.

My girlfriend is a Chinese national on a Tier 2 General Employer sponsored visa, her T2 visa will expire in January 2018 as her contract is coming to an end then, however we wish to get married so she can remain in the UK, and also search for a new job, as companies that offer sponsorship are few and far between in the south west where we live. I am a British citizen.

Question 1) Will we be able to get married at our local registry office? We both live in the same city
Question 2) Will it be possible for her to apply for a spousal visa after marriage - and will her salary count towards the salary requirement? (she has worked at the same employer for over 3 years and has payslips etc) I earn over the salary requirement, but I am self employed - is this likely to make things more difficult?

Greatly appreciate any advice or insight!

Yes, you are however required to give 28 days notice at an HO approved Registry office, who will then inform HO and the notice period can be extended to 70 days for HO to investigate and/or interview each of you separately before granting permission to marry.

Yes, but she must apply before her current visa expires. You can use EITHER income.
