Biometric Residence Permit is expiring.. whats next?

Post by sman » Mon Oct 02, 2017 6:20 pm

Hi,
I came to UK 2 years ago and my BRP is expiring on July 2018.

I have no clue whether to renew it by then or apply for ILR before it expires. My husband has been already waiting reply for ILR since October 2015.

Please advise. Thanks in advance.

Regards,
Mrs. Kuvinten.

In a previous post from March this year, you posted you applied for ILR based on the Set Protection route??

general-uk-immigration-forum/buying-pro ... l#p1462636

So what does your BRP state or what visa do you hold in this post you are asking about??

Hi,

It was my husband who applied for ILR on Oct 2015 and is still waiting for a reply from home office.

I came in settlement spouse visa and got this BRP card when I entered UK which is expiring on July 2018. So what am I supposed to do when the expiry date nears?
1) Apply for BRP renewal ?
2) If Yes, for how long?
3) Apply for ILR straight away?

Regards,
Mrs. Kuvinten.

What date did your visa start and what date did you enter the UK?
1) Apply for BRP renewal ?

You have to apply for a visa extension.
2) If Yes, for how long?
A 2.5 year extension
3) Apply for ILR straight away?
You don't qualify for ILR as you don't have 5 years residence.

Hi,

1) My visa started on 29/10/2015 and I entered UK on 14/11/2015
2) What's the procedure to apply for BRP renewal for next 2.5 years? I couldn't find any answer for renewal. All I see is for stolen replacement..
3) oh okay, noted on that.

Mrs. Kuvinten

Hi,

My mother's visitor visa got rejected and I don't think she is going to come here for confinement. So I need to go and visit her with my baby for that I need a valid BRP in hand to travel abroad.

Could you kindly help me or advise me to find the procedure to renew my BRP card?

Regards,
Mrs. Kuvinten.

You are NOT apply for a replacement card. You MUST apply to extend your visa on form FLR(M) shortly before your current visa expires.

You need to have a valid visa to come back to the UK.

You seem to be misunderstanding and not reading the responses.

You must apply for a visa extension meeting all the same requirements as you did for your first visa. It is not just a 'BRP card renewal'.

Hi,

Regret the inconvenience.

This is the first time I am facing this and don't have anyone within my friends with the same situation to clarify. Hence the confusion.

Thank you for your advice.

Regards,
Mrs. Kuvinten.

Link below is the forum and the guidance note to extend your visa.

https://www.gov.uk/government/publicati ... -form-flrm

You need to pay £500 Immigration Health surcharge PLUS the visa fee which is £993 by post or £1583 if you apply in person.

No problem, you can ask any questions you have in this topic. Note that it is too early to apply now and the visa fees are increased in April 2018.

Hi CR001,

Sorry to trouble you again, last quick questions.

By December 2017, will be giving birth to a baby girl.
1. So what will be my baby's visa since then?
2. Will she be included in my current visa?
3. If yes, then when I am extending my visa by July 2018, do I need to include my baby as my dependant?
4. If yes, will my fees increased (£993*2 + £500*2) including IHS for both of us?

Please advise.

Thanks in advance.

Regards,
Mrs. Kuvinten.

If your husband has ILR at the time of the child's birth and the child is born in the UK, the child will be automatically British and can apply directly for a British passport.

Child will need to be named on your application but DOES NOT need a visa.

Hi CR001,

I don't think my husband will get a response from HO before my delivery. He is already waiting for it since 2 years.

So in that case I will have to include my baby into my current visa? Is there any way to update my current visa to include my baby?
And pay for myself and baby when extending it on July 2018?
So the fees I need to pay would be £993*2 + IHS £500*2? Am I correct here?

Please clarify.

Sincerely,
Mrs. Kuvinten.

I applied for settlement visa to enter into UK. And my BRP says spouse of Kuvinten.

My husband was a refugee when he entered UK and got travel document for 5 years at the end of which he applied for ILR. Per HO, until he gets a response from them, he continues with the same visa.

Hi CR001,

Agreed that my husband needs to wait till he hears from HO on his ILR.

But my clarification is about my baby, i need to take my baby with me to my home country to be with my parents for sometime. For that, what do I need to do? (Include my baby on my visa when extending it on July 2018 as my dependant? If yes, how about the passport for my baby? Will my baby included in my current passport before we travel abroad?)

Please advise. Thanks in advance.

Regards,
Mrs. Kuvinten.

You will need to apply for a passport and a visa for the child. If the child doesn't have a passport they cannot travel. If the chidl doens't have a visa, the child cannot return.

Hi,

My husband got his ILR when my baby is 3 months old. So I have sent Form MN1 application already to Home Office to register my baby as British Citizen.

Questions:
1. Once she gets the registration certificate then the British passport later, does she need to apply Sri Lankan visa to take her a visit to my home country to see my parents?
2. Am still in BRP, for how long can I stay outside UK?
3. My Spouse Visa is expiring this July and I need to apply visa for next 2 years before I travel to Sri Lanka. How long does it take to get my visa approve and to get a new BRP card?
