Hi everyone my question is that my wife she has been living in Uk for 1 year now on spousal visa. Gave birth 2 month ago. what I am asking is that if i were to receive benefit houuse benefit. will this affect my wife to get indefinite leave to remain next year?

Cause I am living in one bedroom and I want to move to 2 bedroom flat is that okey to get help on rent ?

You do not say about your status. Are you British, or otherwise settled in the UK?

Assuming the answer to that is .... yes :-

Yes you can claim HB. The logic goes like this. Because your wife has a restricted visa with the No Recourse to Public Funds restriction, you cannot claim more HB because she is living with you. However, there is also a child and accordingly, because the income disregard for "a couple with one child" is the same as for "a single person with one child", you cannot possibly get more HB because she is living with you. So you are totally entitled to claim HB.

Other benefits? Presumably you, and certainly not your wife, has already claimed Child Benefit? And the two of you jointly have claimed Tax Credits?
