60+ days Employment gap - Will it affect Naturalisation?

Post by JoeLawerence2 » Sun Oct 15, 2017 1:35 pm

Hi guys, I received ILR on basis of 5 years on Tier 2 General visa. I had more than 60 days gap (5 months) between employment but at the time of applying ILR there were no cases of refusals due to employment gap. I can see that over the last few months there have been a lot of refusals due to more than 60 days gap between employment.

I have just applied for Naturalisation now, so my questions are:
1) Will this employment gap be an issue of Naturalisation as my ILR was on basis of Tier 2 General visa?
2) If at all my Naturalisation is refused on basis of the gap, will my ILR be revoked on basis of that?

Thanks :)

Employment is not a pre-condition for naturalisation, so not an issue, you will not be refused.

Thanks Alterhase. I know employment is not a pre-condition but as the ILR was based on Tier 2 General visa, and the employment gap rule was valid at the time of applying ILR. Do you think it will still not be an issue?

You will be at the case worker mercy - they have full discretion. Don't like the colour of your hair - rejected (thank you very much for the £1300 for the exchequer by the way), don't like what you do for a living - rejected, have a hangover from the weekend long partying - rejected. And they don't have to explain anything and you don't have the right to appeal... but you can always apply for reconsideration (another £300 to the exchequer thank you very much), or reapply completely again hoping for a different caseworker and outcome (should I mention another £1300 to the exchequer thanks).
All I can say that even if you get all the paperwork in order and it's the simplest case on Earth, it's still like you are betting £1300 per person on the horses at a bookie.

It should not affect your naturalisation result. Citizenship LAWS are completely separate to Immigration RULES.
