Good evening everyone,
Apologies if this has been asked before, I’m asking on behalf my father. He made his application for ILR on the 27th Feb 2008 and it was granted on 13th Dec 2010 ( Set O application 14 years over stayer )
Now we have been thinking about applying for his citizenship but am confused about the following statements:

You must not have been in breach of the immigration rules in the 5 year period before making the application ( see the section on breaking immigration rules )

&

Just because you were given ilr does not mean that we will automatically disregard the time you were in breach of immigration laws during the residential period. This includes breaches in the year period before you apply for Naturalisation.


So he has held ilr for almost 7 years, which clears the first statement, but 10 years ago ( good character requirement ) he was still illegal although he had started his application in Feb 2008.
So do we need to wait 10 years due to the good character requirement, or is it just 5 years.

Apologies if I’m misunderstanding the guides or asking a silly question. Just want to make sure we apply at the right time for my dad.

You need to wait 10 years from the date he got ILR, so December 2020.
