Non EU Spouse visa. Employer lost my contract !!

Post by olosh » Sun Oct 29, 2017 1:58 pm

Hi I am UK citizen applying for my Non-EU spouse to join me in the UK. We have been married 12 years and we have a 9 year old child. I am pretty sure I have a good strong file, but my employers have lost my original contract of employment !! The only copy of the contract they have on their system is signed by them but not by me. They have printed of a copy and stamped it, but I am worried that my signing the printed copy in pen afterwards might look a bit odd. Is this likely to cause any problem ? They have provided a good letter confirming my permanent employment status, start date and salary, but the HR people do not want to give a new contract.

Be pleased as no contract need rather only payslips and employer letter from employer.

Bear in mind the following:
In respect of salaried employment in the UK (paragraph 2 of this Appendix)... the applicant may, in addition to the letter from the employer(s) required under that paragraph, submit a signed contract of employment. If they do not, the Entry Clearance Officer or Secretary of State may grant the application if otherwise satisfied that the requirements of this Appendix relating to that employment are met. The Entry Clearance Officer or Secretary of State may request that the applicant submit the document(s) in accordance with paragraph D of this Appendix.

Hmm. Well my employer have given me a good letter, they have stamped all the payslips and a P60 and I have a stamped bank statement, with a printout from the ATM to corroborate the last balance and most recent salary payment.

The contract is scanned and printed, and the front page (with my name on) is stamped. The signature of the company officer is printed, but my signature and date are done after in pen. It seems they filed the wrong copy before I signed it or something like that.

It seems like this might not be a big deal, but I just do not want to take any chances whatsoever and I frankly I just do not trust the home office :-(

Preferably don't attach extras like p60s, scanned contract, Atm balance slip. Better than Atm balance slip to show recent salary you go to bank and ask for recent bank statement/statement of entries on letterhead which most often is not a big deal.

I have got a 12 months bank statements printed in the bank and stamped on every page. But it is on normal, non-headed A4 paper which IMHO anyone could mock up. So I have attached an ATM printout which corroborates the balance and the last few entries, and may be seen as less easy to imitate as it is on special ATM printer paper with bank branding. That was my reasoning anyway.

My solicitor seems to think the contract is important, and I think the P60 was suggested on another forum. But surely there cannot be any harm in giving extra documentation ? I would have assumed too much would be better than too little.

I wish your solicitor guide you well. But I disagree that extras should be attached because it can cause confusion. Always relevant & precise documents yield better & prompt result. If you still wish to attach extras then can go ahead but share your experience.

I see what you mean. But we previously had a visit visa refused for 'lack of supporting documents' so I am kind of paranoid about losing nearly 2 grand for this application if it is refused for any stupid reason. I cannot tell you how much I hate all this kind of stuff, it is killing both me and my wife from stress and anxiety.
