Dear Moderator ,

I am writing this post on behalf for my brother who is currently holding ILR. He has concern regarding his wife who was granted Spouse Visa for 2 and half years back from country providing all relevant document. Now time has come for his wife for extension, since rules and regulation are changing i want to ask you guys , as rules required for English Language , while she apply initial she provide ESOL International Test certificate Council of Europe Level B1. which was passed back home, so now for this extension does she can provide same certificate document shown back in initial for English Language Requirement or does she need to new English test for eligibility. Your speedy reply will be highly appreciated.

2.2(b) (b) the applicant-
(i) has limited leave to enter or remain in the UK, and
(ii) that leave (or a grant of leave which preceded it provided any periods of leave since have been unbroken) was given on the basis that the applicant had an English language qualification at a minimum level of B1 on the Common European Framework of Reference for Languages.
(iii) at the date of application, the provider of that qualification continues to be approved by the Secretary of State as specified in Appendix O to these Rules.

So, if on the date of the extension application, ESOL is still specified on Appendix O as accepted test, she can use it.
