what income documents I need to submit in ILR application

Post by toplxy » Tue Oct 31, 2017 3:41 pm

Dear friends

I'm about to submit my ILR application via 10yrs route next months. Currently I'm a tier 2 visa holder. Just got a few questions if you could kindly help.

1. Do I need to meet the income requirement of 35000 annual salary? If yes, should I provide pay slip or work contract is enough? (The reason I asked is although my salary meets the requirement, I could only provide 4 month pay slip cos I left my previous sponsor employer Feb 2017 and didn't start to work for the current employer until August 2017.).

2. I left the UK on 13/04/2009 before my visa expiry date of 30/04/2009, applied new visa outside the UK and re-entered the country on 17 May 2009. I supposed this would not be considered as a gap but would like to double confirm.

3. In 2014 I applied Tier 2 visa BEFORE my previous visa expired. It was refused first but granted after appeal. Although the grant date was way after the previous visa expiry date, I suppose this would not be considered as a gap. Correct me if I'm wrong.

I appreciate in advance anyone could help.

1. No, not for long residence ILR.

2. Not a gap in residence no.

3. No issue.

start date towards 10 years

Post by toplxy » Tue Oct 31, 2017 7:31 pm

Dear friends,

Have got really helpful information here. And just have a few more enquries.

1. I am going to apply ILR next month. My son was born in the UK in July 2013. He left the country in December 2013, was granted dependent visa in October 2014 and back to the UK in June 2015. Can he apply ILR same time as me? If not what's the earliest time he can apply ILR?

2. My first entry to the country was 10 days after visa issue date. I know usually 10yrs count starting from the entry date. But is it allowed to count from visa issue date and count the 10 days as away days?

Thanks again for anyone who could help.

1. Long residence ILR does not permit your dependents to apply for ILR with you. Your dependents will have to apply for spouse/child settlement visas on FLR(M). If you do not plan on registering your UK born child as a British citizen, the child will likely follow the same visa/immigration route as the other parent.

2. Counted from date of ENTRY for long residence ILR.

Thank you very much CR001.

My further question is:
If my child reaches 7 years of continuous living period before 5 years of child settlement is due, can he apply earlier via 7yrs route ?
If the 7yrs route applies, and the 7yrs can be reached within the child's current visa (Tier 2 dependent), can he stay on current visa status after I get PR?

Many thanks.
