Passport and name change issue

Post by riffraffuk » Mon Oct 30, 2017 7:46 pm

I have changed my name by deed poll after naturalisation and was talking to an advisor on the phone today who told me they will not issue me a passport because I would need to change the name in my EU passport first. The name needs to be for all purposes so issuing a passport in my old name is also not possible apparently (he first said yes then changed his mind to no)

Is this correct? It will take me a considerable amount of time to sort out the legal aspects in my home country - does this mean I not entitled to a British passport even under my old name?

I was also wondering if my EHIC insurance card is valid when travelling with my EU passport (names match but EHIC was issued before deed poll)

Can I just apply for the passport using old details?

Hello. The starting point is this statement by HMPO:
There is no entitlement to a passport and no statutory right to have access to a passport. The decision to issue, withdraw, or refuse a British passport is at the discretion of the Secretary of State for the Home Department (the Home Secretary) under the Royal Prerogative.
Thus, once we know that passports in the UK are not a right, HMPO may decide not to issue one on the grounds of their one name only policy if you have a foreign passport on another name. Please check out the following documents for further details: https://www.gov.uk/government/publicati ... e-guidance

After the deed poll, have you changed your name on any UK documents, such as your driving licence, or bank accounts, HMRC, etc? If not, just reapply in your original name. You may have to tell them, if asked, that you have dropped the use of the new name. You may have to send some supporting documents showing that you are using in the UK the same name as on your EU passport.

If they still raise the issue that you already sent them a deed poll with a change of name, you may obtain another deed poll changing back your name to the one matching your EU passport.

This is utterly nonsense!

Hey, thank you. I have changed my name with HMRC, bank etc.. around 3 months ago, should have known better! I actually have not applied yet for a passport, was just checking with the passport helpline as I've read in some other thread on this forum people were having difficulties. Until now I was convinced they would just issue the passport under old name if my EU passport is unchanged.
