My appeal was heard on 5th of july and decision received on 12th of july .
And HO letter received for ILR implementation on 4th of september and then received a letter to pay IHS on 4th of october

Yes, your situation is very much similar to me. I got a letter from HO on 27/09/2017 saying they will implement the court decision asap just like you received it. After that i have not heard anything yet.
:? waiting restlessly and hoping for the best.

But the problem is they are trying ti give me limited leave to remain whereas my application and appeal was allowed for ILR.

My solicitor just called me and informed that they have received my BRP card with 2.5 years visa . They did not give me ILR .

Hello everyone, I've been a silent reader of this forum, and it will be selfish of me not to share my good news. You never know who may benefit from your testimony.

The people that may benefit more from my testimony are those who are using their derivative right of residence to apply for ILR on the basis of 10 years long residence in the UK.

Here is my story;

My wife was first granted leave to remain as the primary carer of our EU minor son under the defunct paragraph 257C of the Immigration Rules in September 2008. I was on another leave at the time and separate from my wife and son, but my subsequent renewal of that leave was not successful and I became an overstayer around 2009.

I made a fresh application as the father of my son who, as I mentioned earlier, was already exercising his treaty rights as a self-sufficient child. By the end of 2010, I was granted limited leave in line with the rest of my family.

In October 2011, our son was granted a document certifying permanent residence as we were able to prove that despite my wife being granted her first leave in 2008, our son was actually exercising his treaty rights way earlier than that. Our EU son who is still a minor completed 10 years as a qualified person in the UK in October 2016.

From that October, we started the journing of Life in the UK test and the English test and by April 2017, we passed all the aforementioned.

Timeline for ILR under the 10 year long residence route are:

Application posted (two separate application in one large parcel) first week of April 2017

Biometric letter first week of May 2017

Then the monthly email stuff.

On 16 October, we were refused. Reasons are my wife was first granted leave in 2008 and myself 2010, and therefore we have not had lawful leave for 10 unbroken years. Reference was made to paragraph 276b (i)(a).

We knew this was a mistake on their part because a person with a derived right of residence does not need a derivative residence card to make his presence lawful. So, We wrote a polite letter on 26 October 2017 to the caseworker at Liverpool to remind him that for the fact that our son was granted a document certifying permanent residence in October 2011, legally means he had been a qualified person since at least October 2006, consequently, as he is the source of our rights, we too have had our continuous right of residence since the same time even though we were not actually granted leave until 2008 and 2010 respectively. We also sent a letter before action to their office in Middlesex.

Guess what folks??? We both received our approval letter for Indefinite leave to remain yesterday, saying the Biometric cards will follow under a separate cover.

We are so grateful to our Lord Jesus Christ, no lawyer we did everything by ourselves.

By the way the online application checker is showing 'Decided' and we are yet to receive a response to our JR threat, but who cares as long as the remedy we sought has been done.

First of all Many Congrats! for your BRP. At least you have a valid status to work.
I understand that this looooooong and restless wait can drive anyone crazy.

Did they send any letter saying why did they only grant you limited leave and not the ILR.
Tell your solicitor to contact HO and you should also contact them regarding this.

I am still waiting for my BRP. :S

My solicitor sent them a letter when they sent me a letter to pay IHS, explaining the judge’s decision and attaching the HO approval letter but they didn not reply to that letter and sent this BRO straight away and it has 30 months visa .Now i will have to file a JR i was told by the solicitor.
I hope you get your ILR soon.

Appeal refused but futher appeal rights given:-------04/2017

Applied fresh application set (lr):-------05/2017
Biometrics done:------06/2017
received letter from HO saying Fee page is missing. fill the fee form and send it back within 10 days:-------17/10/2017

Not sure how long more do i need to wait to get application decision as its alredy been six months passed.

It seems they must have decided about the limited leave before asking for IHS fee.
Hopefully you will get it sorted via judicial review.

Hi there , i need a technical solution for my problem,
I came in the UK in 2010 as tier-4 student and getting extentions successfully,

Couple of month back i got visa extention of 5 months because of delay in my dissrtation which i had got successfully,

During my that 5 month visa i went back home and when i came back uk they refused my entry because thay said "visa less then 6 month is single entry visa and it was expired when I traveled back home"

Thay gave me temporary entry for one day and arrange my flight for next day, i came to the airport and went back home as they offer me the ticket as well,

Within 6 month time i came back UK , as same tier 4 visa,

I just wanted to ask about my continuety is valid? To keep it valid i am paying so many fees to the uni.....

Will wait for your positive and relayable answer, i had not over stayed as they arrange my fight , i went back, and apply from back home and came uk within 180 days

hi i applied ilr last year on set(0) with amendment year of 2010-11 . i applied i in august 2016 and i declared my amendment tax in Jan 2016 to hmrc and they agreed with installments. after 15 months i got letter yesterday from ho, '' i had complex issues in my application so my application is delayed otherwise its take 6 months''.
now i have question i completed 10 years last week so any chance if i go for it and my wife she did not completed 10 years . so if i applied what her status .please tell me know asap. many thanks.

Till my knowledge, and experience too

you cant make a new application if an old application is still there with home office which is undecided

if you make, home office will 90% return the application and refund the money too.

What you can do is differ the application to long residence from current application.

but never ever withdraw and apply

if you do it will break your continious stay withing the United Kingdom and then you are not eligible for ILR anymore.

your wife status will be confusing too, because in long residence application you cant have dependent till your visa is granted.

Means you have to wait for your visa first and once you get then only she can apply.

usually in such scenario applicant or their solicitors apply flr fp for the dependent telling the HO to hold the dependent application till the main applicants application is processed.

but home office is not our Uncle, they refuse straightaway without right to appeal and this puts the dependents status in dilemma


so think before you do something... Ask seniors who would guide you

Hi mate ,

You can vary your application to LR any time as you have completed 10 years lawful residence in the UK . Also you don't need to pay full application fee . just pay the difference If any ..

Regards to your wife application she has to put separate application FLR(M) .

Thats all . I strongly advice you to check this with a senior member or solicitor .

I am also thinking of doing the same. Have been waiting for a long time even after appeal approved.

Hi All

First I thankfully to every one specially CR001

My ILR long residency has been approved on premium service at Croydon

Documents
Passport covering last 10 years
Covering letter from my solicitor with details
As my three appeals has been allowed so we have attached all the judgements
Council tax statement
Life in UK
B1 WITH DISTINCTION
Previous Biometric Card T1 Entrepreneur

Very long journey as I was there at 9 last month
Biometric done at 10
Case with case worker at 1 15 for consideration
Got call from Case worker at 2 10 as he want me ask few questions
He ask me about Toiec as I have replied that all judgements are there which he was appreciated
And he said what business you are doing now
I replied that I just got T1 Ent only three months ago so we are in process and show him emails conversation with company
And he asked for bank statements which I have provided and show him still there is money available in my savings
He was looking cooperative but said I am very convinced about the history as there is no any absence from last 10 years but really confused from 3 judgements so I need to speak with my Senior managers which i said ok but please take in the account that all the appeals has been allowed
He said thankyou for your time

Then nearly at 4 30 approval letter has been issued

Thankyou once again

Now I am looking to apply for my wife as she is my PBS dependent and need to switch on FLR M on basis of 62000.00
So it would be really appreciated if some one could help me on that
I already applied MN 1 application fir my 6 yr 11 month old daughter and Biometric gas been done

My solicitor said I cannt switch my application from Set(lr) to Premium service. Can anyone please advice me after reviewing my application history. Its already been two years nearly when I first applied my application.
