Irish citizenship child born in northern Ireland

Irish citizenship child born in northern Ireland

Hi

My child was born in Belfast northern Ireland on 2014. I acquired indefinite leave to remain (from UK government) on 2017
I moved to live in northern on 2012 where I had a UK visa
Is my child entitled to Irish citizenship as he was born in the island of Ireland and I now have indefinite leave to remain in northern Ireland?

No, because Irish nationality law requires one parent to be either a British citizen, an Irish citizen, have ILR (in Northern Ireland) OR have resided in any part of Ireland legally for three of the immediately preceding four years at the time of the child's birth in order for the child to have an entitlement to Irish citizenship.

See Section 4 of the Irish Nationality and Citizenship Act 2004, which amends the Irish Nationality and Citizenship Act 1956.

would the child be entitled to Irish citizenship when he is naturalized using MN1 application as he will then be British born in northern Ireland

No, because Irish law requires certain conditions to be met at the time of the birth of the child, not later, in order for the child to be entitled to Irish citizenship.

Subsequent registration under UK law does not grant your child an entitlement under Irish law. S/he can of course meet the registration/naturalisation requirements under Irish law as required, but it is not an automatic entitlement.

Were you or the other parent resident in Northern Ireland for three of the four years immediately preceding the birth of the child?

No only 2 years in northern Ireland before the birth of the child. We were in England for 5 years before that. I obtained ILR from UK recently and was wondering since I can reside in northern Ireland without restriction would this allow the child to get Irish citizenship. It seems not from your answer
