dual national help please!!

Post by mohab1 » Mon Nov 13, 2017 1:47 am

my british passport expired on 22/10/17. i was born in birmingham on 27/4/75. my parents are egyptian so i acquired my first egyptian passport around 1979 when i was four ie dual national. i have had 2 egyptian passports with the only one remaining which was issued in 1987 and expired 1993. i sent that to the PO after declaring dual nationality. all is good till now. my middle name is naim and is written as such on my british passport. i received a letter from the PO stating that my name is different on my egyptian passport. this is because 30 years ago in 1987 my middle name was spelt with an extra e giving naeim my mistake. i cannot get a new egyptian passport with the right name issued because i would have to travel to egypt and process a list of other documents and at the moment both of my passports are expired so i have no passport anyway to leave the country. i also have a medical condition for which i cannot get reliable treatment abroad. my mother is going to try and contact the egyptian consulate to see if a letter can be issued or some kind of stamp on the expired egyptian passport proving that my middle name was spelt by error with one letter out of place 30 years ago. i guess they would use my birth certificate//photocopy of expired british passport as a guide. this is the first time i have been asked to show british authorities my egyptian passport on applying for a UK passport renewal.

if i am not initially issued a new british passport ie its refused does that affect my right to live in uk as normal? i was born in birmingham in 1975 so i am a british citizen. i've been having disastrous scenario thoughts as i don't know anything about this.

can anyone advise with this problem i feel trapped from every angle?

I am not certain anyone on here will have come across this specific scenario before and can tell you exactly what to do.

I find it a bit odd that they would ask you to confirm this now, when you are only renewing an existing, expired British passport.

For now, there are just two things I can think of which you can do:
- Reply to the Passport office explaining the situation and pointing towards your previously expired passport. Maybe, if they prefer they can spell your middle name like in the Egyptian passport
- Follow the route your mother suggested and try to get a certified letter explaining the middle name.

I don't think they can 'take away' your citizenship again because of this, so I wouldn't worry too much. It can be a bureaucratic nightmare though :(

This is part of the HMPO one name for all purposes passport policy. It will not affect your British citizenship, but may affect your right to obtain a British passport because British passports are not a right. They are used under Royal Prerogative powers and the Crown has discretion as to the rules they set and who they issue a passport to.

If you are a dual national HMPO will ask to see your other country's passport and will only issue a British passport if both names are the same.

You can do as your mother says and HMPO may issue a British passport with an observation that you have another foreign passport with a variation of your name. This, however, will require some persistence on your part.

Alternatively, if you don't use your Egyptian citizenship, you may renounce to it and show proof to HMPO that you are no longer an Egyptian national, so that the issue you with a British passport in your current name.

Finally you may change your current name by Deed Poll so it matches that of your Egyptian passport and get a new British passport in the same name as your foreign passport.
