Switch Tier 2 to Tier 1 Entrepreneur visa

Switch Tier 2 to Tier 1 Entrepreneur visa

Dear Experts

Please can you share your valuable advice on below queries.

My wife is currently on Tier 2 visa from last two years and before that she had Tier 4 visa. She wanted to switch it now on Tier 1 Entrepreneur category under £50,000. I’m on her Tier 2 dependent visa – PBS Dependent category.

1. Is that possible if she can switch from Tier 2 to Tier 1 Entrepreneur visa with access to £50,000 funds.
2. Do I’m also eligible to switch my visa from Tier 2 dependent to Tier 1 dependent at the same time.
3. She had already spent two years on Tier 2 visa, is that possible if these two years will be counted for her ILR in total time spent.
4. What would be chances of ILR after spending 2+3 years on Tier 2 + Tier 1 categories.
5. Will I be eligible to work full time after switching to Tier 1 Dependent visa.

2. Yes

3. No, she will need 5 years on Tier 1 Ent as far as I understand. The combination I believe can only be used the other Tier 1 plus Tier 2 as most recent leave, but I stand to be corrected.

4. See #3 above.

5. Yes. Nothing stopping you from working full time now on tier 2 dependent so not sure why you have asked this.

Thank you for your valuable advise,

1. For funds, we will be taking some help from our family (Parents) as a loan and some part is our savings.

2. I believe if she needs to spend 5 years again for ILR then we might not choose to switch Tier 1 Ent category.

I've one last query :- Please can you suggest in which Tier 1 category she can switch from Tier 2 and work independently also her time spent in Tier 2 visa is also counted in terms of ILR.

She wanted to quit her job and work independently for some time.

She can't use the £50,000 route like this. There are very specific requirements that must be met to qualify for the £50k route.

4. Access to £50,000 investment funds

You can apply if you have access to £50,000 in investment funds from one or more of the following:

a UK entrepreneurial seed funding competition endorsed by the Department for International Trade (DIT)
a UK government department making funds available for the purpose of setting up or expanding a UK business
a venture capital firm registered with the Financial Conduct Authority (FCA)

There is no longer such a category (Tier 1 General). The route was closed due to abuse of the system.
