commonwealth - advice

According to 1971 act s7 which is still in force according to HO website, Commonwealth citizen who is an ordinary resident in the UK for 5 years cannot be deported or removed.Does it mean that for example, Commonwealth student after 5 years could stay in uk indefinitely if he wishes so?

so what's happened if she(he) ,being ordinary resident but without ilr refuses to leave? became illegal resident without right to be deported? Interesting situattion what do you think?
