Tier 2 Licence Suspended. Need some help!

Hi,

Yesterday my company received the sponsorship suspension email from UKBA after a visit two months ago. And the company got 20 days to respond and they will. In the meantime I have couple of questions if someone can help!

1. If I look for another sponsor in the meantime, and if i get a new sponsor, will my wife has to go back to home country to apply for the dependant visa again? Or can she apply for the dependant visa while I am applying for my NEW tier 2 with the NEW sponsor? [Assuming, if revoked and I got a new sponsor]
( She is currently in UK with me and doing a job here ) [ My visa had been granted until 2020 before this suspension. We both got the BRP with us, but I guess it's not valid if the answers of my company are not satisfactory and if it's been revoked. ]

2. What is the probability of revoking after submitting the answers to the UKBA within that 20 day period? ( I didn't see the full email from them, but had an idea that its been suspended due to some problems with the employees. They had been doing some non related work rather than the COS description. One had a problem with the address. His address which he had provided in the application was not the correct address and in UKBA visit, they had noted that. Another employee's COS had been downgraded by the company and that had been questioned by the UKBA. But all his duties remained same though a downgrade had been requested. I think, this had been noted in the visit too, ( 100% not sure, but i guess ) Depending on these circumstances, I hope someone will help with useful information.

3. Two of my friends had applied in the meantime and now their applications are on hold. If revoked, will they receive their passports back to try and find new sponsors? Or are they sending them directly to airport? ( One rumor told that they are sending directly to the airport )

Any help to resolve these issues will be highly appreciated!

1. if you find a new job and change visas, she doesnt even have to change her visa. she can continue on her existing dependent visa as long as u have a visa. If she needs to renew it, she can renew within uk.
2 no one can tell u a figure of probability.
3. If the suspension is not sorted and is eventually revoked, then their application will be rejected and passports will be given at airport

iworker, one small question. Today I got some information from HR about the suspension. It is highly likely to be revoked. But still we'll submit the answers with proof as they (HR) say. My friends are little worried as their application is with them right now and if revoked, as on your answer they are sending that to the airport.

Is it the final decision? Are there any examples like that? If possible, can you please provide us a place to look into more about this? (Any link / document would be appreciated)

Is there any chance to get their passports back and try a new sponsor within a time period?

Are there any possibilities /actions for my friends to take in the meantime? (Because we all were eyeing for the ILR from another 1 1/2 - 2 years.

Crazy_p, Sorry to hear that your situation. Any update from home office after your HR submitting the documents ?? Did they submit this documents via Lawyer ?

We having the similar situation but home office visited on Oct '17 no replay from them yet. More likely we will receive a suspension.

Hi Virat,

We submitted the documents via an email and via posting too. That is because when there is a suspension notice, we receive it both in email format and as a hard copy via post too.

No, we didn't submit them via a lawyer. Because the suspension notice was addressed to our company director. But we took some advises from our lawyer regarding the points they had mentioned.

Still we didn't get any update. ( there is no time for an update as it is less than a week after the submission )

I'll keep updated as soon as we hear from them.

Hi dks,

We submitted our answers last week (10th Nov). Still we didn't hear anything. I'll keep you all updated if we are having any sort of a development.

Waiting for CR001 or any moderator to answer on the passport issues. iworker in the above answer told that they are set to the airport as their valid visa is over by now. (IN CASE OF A REVOKE) But I couldn't find anyone / post with such an experience. So, my friends are little worried on this.

Hi Crazy_p

I talked with my Lawyer he said yes they will send the passport to airport but However they can switch other eligible category inside UK within 60 days time.

When they fill their new visa application form there is a option you can tick passport with Home office and clearly explain their situation with a cover letter. In addition Copy of their passport bio data page(Hope they got a photocopy with them).

Hi Virat,

Thanks a lot for this information. That would be a much relief for my friends in case of a revoke. I'll pass the message to them asap. It will be very hard to get another COS from another company or CAS from a uni when the passport is not there with them. But at least they have an option thanks to this in the worst case scenario!

As its almost a week after the document submission, we are waiting to hear from HO with their decision. Not sure how long will it take though!

If anyone having the same experience of a suspension, can someone share their experience with the decisions they received and how long did that take to get a decision after submitting the documents within the 20 day period?

Still nothing! Waiting for HO to reply. Findings suggest that it will take at least 10 weeks for a response. But if there is anything new, I'll for sure update the thread. I know all we are in the same boat.

Btw, what is your case? Did you get a suspension notice too? Would be great if you can share details about your case!

Hey @crazy_p sorry to hear but I'd start looking for a new job / sponsor. I was in a similar situation so I know the feeling but managed to pull through after looking for alternatives.

Also can tell you from experience that a long delay from Home Office responding to your sponsor is not a good sign.

Totally agreed! Much more time means, things getting worse. In my case, I've got the BRP till 2020, and in case of a revoke it will be curtailed to 60 days. Need to start thinking / finding alternatives as you suggested! Thanks for these useful info and happy to hear that you've gone through the hard times.

Hi CR001,

One small thing to know! As I was looking for the options in case of a revoke, I was to look for another sponsor. If I find one,

1. Will my previous 3 years as a Tier 2 employee disqualifies for the ILR if my new sponsor ready to offer 35.5kpa by the time i qualify for the ILR?
2. Can I switch to a SOC code with a less salary than my current salary? (Eg: If my current salary is 32kpa, can i switch to a SOC where the experienced salary around 30.5k pa? )
