It has been three months and a week since i have received appeal approval letter from court. Most of the people get BRP in three months plus minus a week or two.
I think in my case it is taking longer as i also have my two dependents in the application.
I hope that i will get our BRP soon as it well over three month after appeal approval letter received ;( .

What is you case and timeline?

I applied ILR (LR) in June 16 and refused same day. They returned all the documents as I had another visa. Appeal was on 28 July 17 and appeal allowed on 10 August 2017. 2 Oct 2017 Post decision unit said they want to implement judge decision asap and requested current passport which I sent. After that no reply although 3 months passed since appeal allowed.
My solicitor wrote to them and no reply.
Mp called and they said they doing further checks.
I don't think they are following 3 months deadline.

Yeah true! i think three months rule is no more being followed.
Do you think that we can go for premium upgrade service at this point?

Hello all, I need some clarification on qualifying period.

My first entry clearance (student visa) was 23rd January 2008.
I arrived in the UK on 3rd February 2008.

Is the qualifying period 28 days before 23rd January 2018, or 28 days before 3rd February 2018?

Also is it ok to apply on the 28th day before (premium service centre) or must it be after the 28th day before? In other words, assuming it’s 28 days before 3rd February, will that be Saturday, January 6th or Monday, January 8th?

Your qualifying period starts from the time when you entered UK which is 3rd Feb. 2008. you are completting 10 years on 3rd Feb 2018.
If you want to use 28 days margin advantage then it should be saturday 6th Jan. To be on safe side you can make it Monday 8th Jan.
If you have time on your current visa you should always put yourself on the safe side to avoid any trouble later on.

IM IN THE SAME BOAT AS U BOTH ARE I CURRENTLY HAVE EEA2 RESIDENT PERMIT WHICH IS VALID TILL NOV 2018. I HAD A FEELING THAT HOME OFFICE MIGHT GIVE ME 30 MONTHS LEAVE RATHER THEN ILR SO I WROTE TGE LETTER TO CASE WORKER ASKING IF THEY ARE NOT CONSIDERING TO GIVE ME ILR THEN PLEASE DO NOT GIVE ME VISA ON OTHER CATEGORY OR 30 MONTHS AS I ALREADY HAVE LEAVE TO REMAIN UNDER EEA REGULATIONS AND I WILL BE ELIGIBLE TO APPLY FOR EEA PR NEXT YEAR IN NOV 2018.
ANY SUGGESTIONS???

Hi nirzzuri , I'm also in same situation as yours . Completing 10 years in January 2017 .

Which visa you are on now ? Have u booked ur premium service ? Which centre you gonna select ? What are the documents you are submitting ? I am planning to apply on window on 3rd January .

Applied : 30/09/2016 for ILR (LR) after my Tier 1 Entrepreneur extension AR refused
Biometric done : 20/10/2016
Entrepreneur visa documents requested: 25th May 2017
Douments sent :21/06/2017
Online last update : 22/06/2017
MP contacted : 31/10/2017
Online Status Decided :14/11/2017
Approval letter and Documents Received: 16/11/ 2017
Bio Card Waiting...

Hi. This forum has helped me especially reading @eco10 @Archers journey though I was yet to become a member.
I thought to share my experience/timeline which may help others.

Application route: T4 to SET (LR) 10 yrs
Date of application: 12 May 2017
No of Applications: 1 main & 3 dependents (all dependents qualified for 10yrs as they entered the UK same time as me and changed categories or extended same time as I did)
Student visa August 2007-Jan 2009
Date of Entry: 9 August 2007
Post Study Work (PSW) visa: Nov 2008-Nov 2010
T4 Student : Dec 2010-Jan 2014
T4 Student : April 2013-May 2017 (change of University)
SET (LR) 10 yrs : Applied May 2017-30 days early. All applications made in-time and no refusals. However I was worried about early submission of SET (LR)
Acknowledgment email: 7th June (and every month til the 7 Nov)
Biometrics letter received: 07 June
Biometrics done:24 June
Last updated online: Awaiting decision’ 14 June
Online displayed : ‘Decided’ 13 Nov (wasn’t sure if it was a glitch as tracking didn’t seem to be reliant as it’s a trial service)
Received docs, passport and all (4) approval letters: 16 Nov (all smiles now :D ).
Waiting for my biometric card now as two came yesterday 15 Nov and one today)!

That’s my journey and I’m wishing everyone good luck and to remain positive. :D :D

I don't think we can upgrade to premium because its with post decision casework unit.
Did you check online status using case id? Mine saying awaiting decision from long time.
Why they will give 30 months visa if application was for ilr and appeal allowed for that application.

Hi Hassan
You may get ILR as they did not ask you to submit IHS fee. If they were preparing to give you 30 months leave they would have asked for IHS fee.

Yes i have been checking my status online since i have received a letter from PDCU. it is not more than 14 weeks i have been checking the status. Still "Awaiting a Decision".

Yes, i can still check it online even when my case is with PDCU.
I am using the case ID which was mentioned on the letter from PDCU.

Save to note the injuction from the policy
" under these circumstances when granting the leave outside of the rules it should be of same category and duration have they been granted leave under the rules"

These are the last threeines of the upper tribunal judge on my appeal decesion.

In my decision letter it is clearly written that "Appeal is allowed for ILR". Hope everything goes positive with no more delays.

I would like to ask about indefinite leave to remain after 10 year ILR.
1 - I have the right to apply for ILR in 30/3/2019. I have Tir4 visa it will be expired in 29/04/2019.
My plan to apply visa Tir4 In 28/01/2019 .

And then I will apply for ILR in 30/03/2019.
My questions do i have the right to applay for new Tir4 visa and after that few month later applaying for ILR befor tir4 visa expired.?
2- how i will get the ILR visa is it as card or sticker in my passport?, do i have the right to ask only for acard not as sticker. ?
3- can I do living in uk exam before applying application one year .does has expired date ?
4- what document i need to prepare for submit ?

Saahib ali thanks for ur reply. I hope u get ur ILR soon. As we all are dealing with home office and all this applications etc etc for so long and spent thousands of pounds in the process.

I am trying to track my application via tha case id on the letter sent to me by the PDCWU but its saying not recognised its may be because my application has not been allocated to case worker yet ? Ive put the case id without 0.

Hi gadana

1 yes you can vary ur leave from tier4 to ilr

2 u will get ilr as a biometric card

3 you have to pass life in uk test before applying for ILR and its valid for life time

Regarding first question,
Could you please clarify to me
I have Tir4 visa valid until 3 / 04 /2019.
I have to right to apply ILR in 30/03/2019.
But before applying ILR , I would like to renew my Tir4 again in 2/02/2019 for extended my courses .and I will get for one year this means it will be expired 2020 .
My questions if renew my Tir4 visa And get valid for one year ( until 2020) , but in 30/03/2019 I would like to apply for ILR .
So if do that , the home office will ask me until my Tir4 expired and I can apply, or I can ask to cancel my renew Tir4 and After issue during apply ILR .
I have done that because to avoid any issue ( which is privately) .
