My Tier to Visa Ext application is been refused by HO. They wanted me to apply for Review however it says you may apply for review only if you think there is been a mistake from our caseworker.However, there is been a mistake from our side we put an extra half hour on CoS the requirement was 33,300 for 39 hrs but we put 33500 for 39.5 hrs which exceeds the salary if we count 2 hrs every week for 52 weeks. The caseworker had counted the salary 33500 for 39.5 hrs which comes up to £33,075.95.
I applied on 14th Of September 2017
My visa expired on 17th September 2017.
The refusal came this morning.
I have been given 14 days for Review.
If I go for review do I have to submit a new CoS Or can my employer amend the old cos and put the exact 39 hrs? and attach a covering letter highlighting the mistake.
I am not 100% sure what to do, do I have to go for review or make a new application for same day service?
what happens to my dependent applications if I make a fresh application just for me? do I have to apply for my dependants aswell or not? or HO will consider my dependant's previous application.
can anyone please advise me on this ASAP

its actually exceeds 2 hrs a month which means my wages should have been more than 33,500 I don't know what to do?

My understanding is as follows, as HO bases their calculations on 39 hours per week.
33,300/52/39 = 16.42
33,500/52/39.5 = 16.309
16.31*39 = 636.07*52 = 33,075.94

HO base the salary calculations on 39 hours per week, so their decision to refuse would be correct. What is your SOC???

My SOC is 3545
It’s a pure mistake from my HR she put 39.5 hrs by mistake. I have already consulted them this afternoon they are going to Generate a new CoS on Monday with exact (39)hrs with 33,500 pa
Salary.

the correct figure is
33,300/52/39=16.42 p/h
16.42*39.5*52=33,726.92

I appreciate your replies as I have figured that out soon I received my refusal papers but I need to know what is the next step. I need to know wether I could make a fresh application and go for same day service?
Or shall I just do a post application and wait? I dont see any point in Review.

Check with your employer if they have available CoS to issue. The can also pay extra to get a CoS on priority.

No you cannot. You will need a new CoS.

I have just checked it there is no current CoS to allocate does it mean my employer have to request another one thru portal?
How long will it take to GET the priority COS?

Hello Again,
My employer has assigned me New CoS. I have filed new application today on same day service. However, HO has not send my and my Dependents Passport. Just wondering to know when I go next week for same day service what would happen as my passport is still in Sheffield

Unfortunately, this is how it works when you don't have your documents. You cannot expect them to process a decision when they do not have your passport etc.
If your visa has already expired, documents are not usually returned to you pending a further application or departure from the UK.

It does make sense what you saying but a couple of months would be an exaggeration as I have spoken a lady at the inquiry center she advised me to have a covering letter explaining the mess.
She told me they may take a decision on the same day or may reply back in 10 days.
