Thanks. Yes it was in shortage occupation list. I think they submitted the documents on the 3rd of November. When did your employer apply? I pray you get a positive update soon.

My code was in NQF level 6, but not shortage occupation. They applied on Nov 1, and this is the second time around as the first one that they submitted was rejected due to improper RLMT.

My points add up to 36 yet no news from UKVI. Getting insanely angsty and I think the rejected application notifications will start rolling out this week too.

Did you ask your employer for an update? Could you ask them to log in and check with SMS?

Hi guys,

I have a question. When employer requests COS via SMS, do they just need to fill a request cos form on portal and if asked then submit documents to HO? Also once it's approved hopefully by 11th dec next month then make the payment of COS and ISC? Am I right?

Thanks.

I am sure they are checking for me regularly and did chase them for an update in between. They have also sent across a mail to HO and also tried calling them. But still no news.

I find this strange as my lawyer mentioned that in case of any missing documents or concerns - HO raises queries with the employer. This is the second time my employer is trying for rCOS and no queries were raised this time.

Any advice on what I can do?

Correct, when the employer applies for the RCOS they only put the details of the job, not the details of the person they want to sponsor. Only once the RCOS is approved, it is then assigned the individual and the CoS fee and ISC is paid.

Hi aokamgba,

Have you managed to see the approval from SMS portal ??
Yes we have seen it in SMS the next day, the RCOS has been assigned to the employee and she has now applied for her visa and has the appointment at the application centre on Monday.

Hmm, my employer submitted the application on Nov 1, RLMT was conducted properly this time and score comes out as 36. Any idea what could possibly be the hold up? Employer also tried emailing HO but no revert as of yet. I'm also guessing that allocation stats for this month come out on Monday, this means that pending rCOS may fall under rejection?

Sorry, no idea what they are doing. I even spoke to a immigration lawyer at a seminar yesterday trying to understand why our application might have gone through as "outside of the monthly allocation" and she didn't know. But she did say they are super understaffed so I wouldn't assume rejection for yours just yet, especially if all the criteria were met. With 36 points I would say you should expect to get the RCoS but don't know what the hold up is.

So is it possible to get the rCOS even after the allocations are out on the gov.uk site for this month?

I saw a few people who received their rcos after the publication on the gov website last month. Allocation last month took longer than we've been waiting so I wouldn't be too concerned just yet. Rejection emails start about a week after the publication. It's fair to assume they're still passing them out for a couple days afterwards.

My sponsor informed me on Friday that my COS was rejected due to salary related details missing in the advert.. However my sponsor completely disagrees the HO response of rejection as they have followed all the standard procedures what they follow to advertise any regular job advertisement. Also the HO mentioned in their response that my application was submitted on 30th Oct which again is incorrect as my application for COS was submitted on 3rd Nov .. So all details are incorrect in the HO response.. I am highly disappointed and confused. It clearly shows they have responded to someone else COS and not mine... I am not sure what to do now.. How Can this be verified.. What can be done... It seems HO is not at all reliable

Hi all,

I also have one more doubt, my job falls under shortage occupation list.. I was just reading online on HO site that jobs following under shortage occupation list doesn't need a Resident Labour market test.. But then I am not sure why my employer conducted it.. Can any one confirm my understanding. This is so that I can go back and instruct my employer accordingly

My job in under shortage occupation list and in my CoS I saw my employer mark no to the following question:
''Have you met the resident labour market test?''

So I think RLMT is not performed for jobs falling in shortage occupation list.
