Hi,
I have just got my Tier 1 Entrepreneur extended until october 2019 . I will be eligible for long residency in 03/12/2017 as i came to UK in 03/12/2007. I have calculated the absences from the country and I have noted i was away for 550 days during the period.
My question with Gurus is can i apply for long residency by extending it 10 days i.e instead of 03/12/2017 i apply on 13/12/2017 will i be eligible please advise ??
Is there any other way i can be eligible .
I believe applying on 13/12/2017 will not bring your absences down to 540 days. You may be able to apply only when your absences in the last 10 years have come under 540 days.
Below are the notes from the long residence guidance.
for overall absences of 540 days in the 10 year period:
o you must consider whether the long absence (or absences) that pushed the
applicant over the limit happened towards the start or end of the 10 year
residence period, and how soon they will be able to meet that requirement
o if the absences were towards the start of that period, the person may be able
to meet the requirements in the near future, and so could be expected to
apply when they meet the requirements
o however, if the absences were recent, the person will not qualify for a long
time, and so you must consider whether there are particularly compelling
circumstances
It might be helpful for an expert to respond if you could post the details of your absences
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.
