I'm applying for FLR FP with premium service however I dont know if a court fine will affect my chances of getting a same day decision, here's the story:
I sold my old vehicle 3 years ago, and for some reason DVLA didn’t remove my name as the keeper of the vehicle.
The current owner didn’t tax it and then got fined for it which came back to me at my old address, I was never aware of this fine as I have changed address and this issue went to court with the court applying for attachment of earnings order to take it from my wages as there was no response from me since I never got any correspondence.
I have now contacted DVLA to remove my name from the vehicle, I also have to appeal the court decision as I am not the registered keeper of the vehicle. So practically I was never liable for the fine and I never knew of the fine which led to court.
Do I have to declare this issue to UKBA as they asked this question on FLR-FP form:
6.5 Have you or any dependants applying with you had any UK court judgment against you for non-payment of a debt, or received a civil penalty under UK Immigration Acts?
My questions are:
1. Is this a UK court judgement against me for non-payment of a debt?
2. I am applying for premium service in-person, if I declare this, will this jeopardise my chances of getting a same day decision?
I look forward to your assistance.
Thanks
