Non EU family member would like to invite parents . which one is batter in current situation family visit visa or EEA .

Post by chaudhary007 » Thu Nov 09, 2017 3:20 pm

Hello everyone . I first would like to thanks everyone here to give their precious opinions on different cases. I applied my EEA family permit 4 years ago witout any layers help with the support of you gues. I would like another openion here in different case.

I am a Non EU family member living with my EU partner in UK since 2013 . I would like to invite my parents (dad 54 mom 50)to visit UK as I don't know if they would like to live in UK or not for long term. About our situation Both me and my partner work full time and have more than £15000 savings for sponsor our parents journey and a 3 bedroom house to accommodate them . about my parents my dad had a private job in school which he used to get paid in cash and recently left his job becasue of some arguments . My mom was always a house wife . Both my mom and dad has nothing to prove their earnings and just a little bit of saving in their bank account. They are finacially dependent on me and to prove this I have got western union account and some other online websites proves that I have been sending my parents some money regulary for the past 4 years as I am the only son in my family . i have the following questions:
1. what is good to apply A family visit visa or EEA extended family permit at this moment (keeping in my currents EU referendem situation).
2. If we apply for them family visit visa will their be any problem as they do not have any earning in India and not much savings either. We will be sponsering them fully.
3. And If we apply For EEA family permit (extended family route) what other documents we can submit to prove their finacial dependency on us and Can their be any other reson for UKBA to reject the Family permit.
4. To prove my parents relation with me the name of my parents on my passport as mother and father is enough or I will need some other documents like birth certificate or some other certificate.
your openions will be appreciated.
regards

Are you married to your partner? if yes, I will suggest below

1. I will suggest you apply EEA family permit since you have proof of dependency.

2. Visitor's visa might be harder given the fact that your parents are currently unemployed and not much of home ties which the ECO has to consider when granting a visa application.

3. I think you are mistaken here, your parents are direct family members since you can prove dependency. Main documents will be the proof of funds transfer and your parents bank statement showing the incoming funds and the amount covers most of their basic needs(housing, food, clothing).

4. You definitely need a birth certificate ( where not possible, court attestation from your country stating that they are your parents). Also remember to add your marriage certificate and your wife's copy of passport

IF UNMARRIED,

Probably go for visa but try to find documents suggesting home ties (Proof that they have something back in your home country that will suggest to the ECO that on balance of probability they are likely to return at the end of the trip)

You can write a letter signed by you and partner stating you are taking full financial responsibility for their trip attaching your bank statement and proof of suitable accommodation(tenancy agreement or mortgage papers)

Thanks for quick reply, I appreciate. :D

Yes we are married.

What is the maximum processing time for this EEA FP? When we were applying from India to come to the UK, they have issued the decision over night, but I have read somewhere that the UKBA can take up to 6 months, is that true? and if so, will it matter for the, if we write in the cover letter that we would like to take them with us on our coming back from India to UK (that time we will be on holidays there). Do you think it may help speed up their decision?? We will be travelling to India in mid February and I am afraid if we apply in December, the decision may take longer than when we are planning to come back.

Second thing is, what supporting documents should we include alongside cover letter? The registration of the land/possessions they have in India will have any impact? :?:

Hi
I am a non EEA national married to my eea national, last year I've invite my dad come over to the uk for 10 weeks on tourist visa and took about a week for visa to be grant, sponsor by my husband, my dad 62 retired no income, support his financially for cost of living show in his bank statement (not a lot) each month from my sister account, it was straight forward. but for you maybe different because you want them to stay here, if you just want them to come visit you and go back I think you should be fine,

Thanks for reply. We actually want them to come only for 2-3 months, like a regular visit, but we read all about visiting visas and EEA FP and we think the seond one is better as we have proves we've been sending them money as a family support. For visiting visa, we read they have to provide 6months bank statemment, and this is a problem as they dont have any income :(
