Employee Id Audit ( Urgent)

Hi,

One off our employee doesn't have Passport, he has ID Europe Nationality but his ID was expired 6 months ago, as he said he will be sorted out soon but if he works with us is an issue or we need to suspend him?

Immigration rules requires you to satisfy all employment rules and regulations - check through https://www.gov.uk/check-job-applicant-right-to-work to see if you are meeting the requirement.

but we have valid Birth certificate.

The guide very clearly says what is acceptable. It is only passport for EEA citizens. The EEA national ID does not show up in the rules. It is upto HO to accept such a document.

D. Nationals from the European Economic Area (EEA) and their non EEA family members.

EEA (and Swiss) Nationals:

All nationals from European Economic Area (EEA) countries and Switzerland, with the
exception of Croatia, are free to live and work in the UK. They may demonstrate their
right to work through their EEA (or Swiss) passport or national identity document
Examples of passports and national identity cards may be seen here and you may
accept an expired EEA or Swiss passport to establish the right to work (although check
the photograph carefully against the physical image of the holder).
The E-passport, introduced in the 1990s, contains a “chip inside” logo indicated on the
front cover of the document and an electronic chip which contains the facial image and
biographical data of the holder

Yes, national ID is acceptable as proof for the employer to check right to work. But that is different from immigration rules for T1E extension.

For example, a PBS dependant has the right to work, but is not acceptable for Job Creation evidence for immigration purposes.

The immigration rules was specifically amended about a year back with additional detail on what ID is acceptable for T1E job creation. And national ID for EEA nationals was not in that list.

Having said that, as @yunas mentioned, it appears UKVI is still accepting the national ID for job creation. It is unclear whether they are waiving that requirement for everyone or just those who were employed before the rules changed.

It is always advisable to comply to the latest immigration rules, so I would encourage that you try and get your employees to at least apply for the UK registration certificate, which is listed as an acceptable document.
