Length of holidays on 5 year route.

Post by elpidiovaldez5 » Tue Nov 28, 2017 6:58 pm

I am a British Citizen. My Cuban partner has been living with me in Jersey (not UK) for 2 years on a spouse visa (although we are not married). We have a 6 yr old child and have been together for 10 years (previously we lived in Cuba). My partner wants to apply for indefinite leave to remain after completing 5 years in Jersey.

We are totally confused about how much time we can spend on holiday out of the UK. Ideally we would spend all the school summer holidays in Cuba (around 42 days/year). In principal we might also spend a couple of weeks somewhere else at other times of the year. I understand that she can spend up to 180 days out of the UK in each 12 month period. That sounds great, but I have also seen that the absences need to have serious reasons i.e. work or health. This seems to not allow one to go on holiday. Can somebody clarify this. I have found so many answers on the internet, but nothing authoritative.

There is no absence limit for dependents/spouse visa holders
