Citizenship application need BRP

Post by Jjbud331 » Wed Nov 29, 2017 4:31 pm

My wife will be applying for citizenship in January but needs to travel a few days after applying. She intends to apply in person at the local Nationality Checking Service which i belive allows her to keep her documents, does this include her BRP and if so how should we fill the form out? Would it be filled as if she had included it or woukd she state not included and state a reason why?

Thanks

Yes - NCS taking copy of BRP counts as submitting it with the application, therefore fill in as "provided".
BRP and other oiriginals will be returned (except LITUK certificate).

Is it possible to apply for citizenship without it? For example if you wanted to apply straight after obtaining ILR at a premium appointment? I believe it can take 10 days to receive the brp after the appointment but she will be leaving the uk to visit family 9 days after her premium appointment. She will ahve the letter stating she has ILR which i belive is given at the appointment if successful.

Would they accept a reason of not received yet?

Thanks

The letter doesn't state 'your ILR has been granted'. It merely states she will get a BRP card in x number of days.

She needs the BRP card. She also needs to be in the UK to enroll her biometrics at the Post Office once she receives the letter from HO.

Why the rush? Apply when she returns and get it right to avoid losing the fee.

Are you sure the letter doesnt state that ILR has been granted? just checked her previous letter issued at premium service for FLR and that states that FLR was granted for 30 month's and BRP will follow in 7 working days.

The rush is that we have to leave the UK the week after the earliest time she can apply ILR as I will be working abroad for 6 months for my company. I have already delayed this by several months to ensure were in the uk to apply her ILR, I carnt really delay any more as my employer is getting pissed at me.

If push came to shove she could hang around for a few extra weeks but wouldnt be ideal and that would also mean me flying back for them to copy my passport.

Been reading the guidence notes and it actually says the letter is what should be submitted as evidence of freedom from immigration time restrictions.

Evidence of freedom from immigration time restrictions
• Your passport showing permission to remain permanently in the UK
• The Home Office letter by which you were given permission to remain permanently in the UK
• If you came to the UK as an asylum seeker you should have evidence that you were not in the UK without permission between exhausting your appeal rights and being granted indefinite leave to remain.
• Evidence of being freely landed, if you did not receive specific permission because you were freely landed as a Commonwealth citizen before 1971 or arrived as a child on your parent’s passport.

Aware she will have to return for biometrics after a few weeks.

Thanks

No, the Ietter issued in ILR grant is different & as confirmed by cr001, it only states that you will get BRP in so many days. You can only apply for Citizenship once you have received BRP. After applying for citizenship, HO can take upto 4 weeks to send you bio-metric enrollment letter.

Ok thanks for clarifying, actually thinking about it in reality she wouldnt be able to go anyway if her BRP hadnt been received as there would be no way of receiving it and getting it to her to return for biometrics. Just have to hope it arrives within the seven working days otherwise she will have to stay here for few week's extra, will lose my money on the flights we booked but she would have to fly back anyway for biometrics.
