Visa for Germany

Hi Everyone,
My husband who is an Irish Citizen and I (Malaysian) would like to move and live in Germany together.
May I know what type of visa should I apply to stay more than 3 months in Germany? Can I apply when I arrive in Germany on my tourist visa? thanks

Citizen of Malaysia have visa free entry to the schengen area.
You have to apply for a residence card (Aufenthaltskarte) in the first 3 month.
Beside that you both have to register residence/address at the town hall after you move in into a dwelling.

I wrote to German Embassy in Malaysia and they have given me a reply.

My Questions are -
01. What is the procedure for me to apply my residency permit in Germany?
02. Can I apply the residency permit directly in Nuremberg in the first 3 months on my arrival?
03. Do I need to apply spouse visa in Malaysia before going to Germany to join my husband?

Their Answers:
1. Please check our website for more information
2. No, you have to apply in your home country or in the country you are currently residing (means you have to have a PR for that country)
3. If you don't have a working permit for Ireland, you have to apply your visa in Malaysia

You are the family member of a eu citizen. Freizügigkeitsgesetz (Act on the General Freedom of Movement for EU Citizens) is applicable for you.
You got the answers for a normal citizen of Malaysia.

Thanks for your info. I will check on it.

My concern is I'm currently not residing in Ireland, I'm here on my visiting visa until Feb 18.
I'm afraid I can't apply the German residence permit during the first 3 months on my arrival in Germany and I have to go back to Malaysia to apply family reunion visa for the application. Anyway, we will give it a try when we arrive in Germany :)

As a citizen of Malaysia you have visa free entry into the schengen area for up to 90 days in a 180 days period.
Your status as a family member of a eu citizen overwrite this limits if you accompany or join the eu citizen.
You simply don't need a visa.
For a stay longer 3 month the eu citizen has to work or are self-employed or studying or being self-sufficient with enough resources and health insurance.
Job seekers get 6 month.
You cannot compare the right of free movement with national immigration law. It is a right not a mercy.
