Advise needed!

Post by worldpeace2017 » Thu Nov 30, 2017 2:53 pm

Hi Folks,

Hope you're all doing well.
I have very unique situation. My wife lives in UK in a Tier-4 DES.
Our baby holds an Irish passport(Republic of Ireland) and is born in the UK.
I was wondering if she can change her immigration status to EU family , then continue to reside and work in UK as EU-family. I am trying to get in touch with someone regarding this and get an informative answer before she makes an application. Thanks in advance to all the good hearts who read and reply this thread.

Regards.

I wish that was the case. I don't work and live in the UK though. I live in Dublin :)
That's one reason I quoted 'unique' situation. Baby is with mommy.

She may qualify as a parent of a self sufficient EEA national child, or as a parent of a settled child. She need to demonstrate sufficient resources though.

Brilliant. This is what I expected. Thanks a million Obie.. Of course she can demonstrate sufficient resources.
Would you have a link in UKVI where I can find out what's needed henceforth? I will be really grateful if you can point me to one. Thanks again.

She may qualify under regulation 16(2). It all depends on the personal circumstances.
