Does my 5 years clock reset for ILR?

Post by ilrmail17 » Fri Dec 01, 2017 12:59 pm

Hi,
I submitted my last application on 11/04/2017 (Previous T2 visa was expired on 04/04/2017) and UKVI granted T2 General Migrant visa on 24/04/2017. The reason for late submission, "my company withdrawn COS by mistakenly and couldn't reassign immediately". UKVI considered that I have a valid reason and granted me a new T2 visa, which is valid up to 23/04/2018.

I was curious to know about my visa status from 05/04/2017 to 11/04/2017 and I requested SAR report from Home Office. Please find some of those details below.

Applied, Country, Visa Type, Start Date, End Date
03/12/2009, India, T4 GENERAL STUDENT, 08/12/2009, 30/04/2011 (Entered UK on 03/02/2010)
28/04/2011, UK, T4 GENERAL STUDENT-LTR, 15/06/2012, 30/01/2012
28/01/2012, UK, T1 HS-Post Study-LTR, 01/05/2012, 14/05/2014
02/04/2014, UK, T2 SW-General Migrant-LTR, 30/04/2014, 04/04/2017
11/04/2017, UK, T2 SW-General Migrant-LTR, 24/04/2017, 23/04/2018

From above you can understand that my last application has submitted after visa expired.

------------------
UKVI raised an application on 05/04/2017 with
Case Type: ISA Data - VNAT
Case Outcome: Closed In Country Valid Visa
Outcome Date: 01/05/2017
-------------------
Minute/Case Notes about Exit Checks Event History - Truncated:
...
04/04/2017 - CID Leave Expired - "T2 SW - General Migrant - LTR" Issued: 30/04/2014

05/04/2017 - CID Outcome: "Probable Overstayer" On "ISA Data - VNAT"
11/04/2017 - CID Application "T2 SW - General Migrant - LTR" Created: 11/04/2017

24/04/2017 - CID Outcome: "Grant L.T.R" On "Ts SW - General Migrant - LTR"
23/04/2018 - CID Leave Expired - "T2 SW - General Migrant - LTR" Issued: 24/04/2017.
----------------------
Minute/Case Notes of my last application (submitted on 11/04/2017):
...
Decision Outcome: Grant LTR under Para 245HD until 23/04/2018 code 4.
a) 5 years from start date of employment would be = 10/04/2022 (I supposed to eligible for ILR via 5 years route on 30/04/2019. But, case worker mentioned it as 10/04/2022. Does it mean my clock reset to zero on 10/04 2017?)
b) End date of employment plus 14 days would be = 23/04/2018
c) The applicant is subject to the 6 year limit and will have completed 6 years on 30/04/2020
------------------------

Am I eligible for ILR via 5 years route? if yes, when can I apply?
Am I eligible for ILR via 10 years route? if yes, when can I apply?

Sorry for long post and thanks in advance.

Well then someone is registered with your VM IP address and has a case with a Tier 2 visa expiry date of 4th April 2017 just like you and your username pops up as their alternative too.

I will leave others to comment on your questions.

Hi,

Thanks for your reply.
I went through that question and it wasn't me. May be some one else from the same company.
Our company has total three branches in UK and all of us shares same external IP.

Hi,

I kindly request you all to please share your thoughts on below query.

From above post, you can understand that my Tier 2 General Visa was expired on 04/04/2017. I submitted my online Tier 2 (premium service) application on 11/04/2017 and I went to Solihull Premium Service Centre on 24/04/2017. Case worker convinced with my reason and granted a new Tier 2 Visa, which is valid from the same day 24/04/2017 to 23/04/2018.

Does my overstay disregarded by UKVI ? If not, how many days did I overstayed ?

Thanks in advance.

The overstaying period will be ignored as your application was approved
