Hi Ans

I'm going to travel from Israel. We don't need any visa to travel to the UK as tourists, so I was thinking of getting back my passport or in case of refusal, to travel with all of my documents proving my marriage to my husband (EEA citizen working in the UK) to join him, and maybe I could get the FP on the border, like the ones travelling by ground.

I don't really understand why is my application considered "not straightforward" because we are married for 8 years, have a child together, he is working in the UK since August, our son is a EEA citizen too.
I was thinking maybe it's because I've stated in the application I am going to work in the UK too and my intention to stay there is for 6 months.

This waiting period is extremely frustrating for our family, very depressing, my employer is losing hope I will ever come, our son is missing school.

Thank you all for writing here, it's the only place that gives me some hope and information. The contact service is absolutely useless.

Hello Everyone,

I have been waiting for 188 working days. ( applied on 24th March from Mumbai) and today I finally got my Family Permit stamped dated 4/12/17. There was no email, no sms, just that the courier guy came and handed the passport. Finally all my stress is gone.

I also received a not straightforward email when I had applied. I escalated for 3 times and waited patiently. For all those who are waiting, just be patient and you will get your FP too.

From all that I researched, I want to share this- If anyone are planning to apply and want their application to be straightforward, provide all the original documents specially of your sponsor(I.e the EEA national). If you cannot provide original, then provide certified copies of passport, national Id, job letter, rental agreement ( you can ask your Eea national partner to get it certified by a notary etc from UK). Provide proof of relationship- pic of you both together( if pics are dated it is good, if not then too will do), original marriage certificate, chat history- get screenshot of Skype calls, whatsapp chat. If you have your pics on Facebook take a screen shot of it too.

You and your partner both should provide a written note about how you met and a little about you marriage etc. List all the documents you are providing.

IMP- count the number of pages of all the documents you will be submitting because at the visa application center they will scan all the papers.

IMP- your EEA national partner should be earning above the avg PTE after tax is cut. So approx monthly salary should be around 1000 and more. If your EEA national partner does not have enough bank balance then you can show your bank balance so as to show that you will have money.

After application just have faith in God and have patience. You will get the FP.

I wish everyone who are wiaiting all the best. I pray that everyone get their visa and join their partner.

I am in Saint Petersburg. Waiting since 26.08.17.

Whenever they tell you (or anyone else) to wait 6 months it's to fob you off. FP should be issued asap, not in 6 months like residence card (which they often take years to issue too).
So don't be discouraged. Best thing for any of us would be to just travel overground. I would have done exactly that if they didn't lie about their timings! Now we're held hostage with no passports. If I lose patience completely (any moment now :) will just get a new passport and go through Calais etc.
I didnt complain or escalate tho, why should they be making money off me by deceit? How much does it cost us all to be stuck because of their arrogance and inefficiency?
Had I been smarter from the beginning the next best thing after NOT giving them the passport, would be to sue for damages if I had costs for accommodations etc.
Dear Amarula, thank you for sending this Spammy Spammer! I agree with you completly in everything! Speaking about travelling on overground.. i read again on other forum somewhere that they do not let people without UK visa inside at the border. They argument this by "we are told not to let inbody in without the valid visa, this is an order°- Even that the officers agree that is not normal. So i woud say there is a risk not to enter. Nevertheless, i am planning to apply for the second passport. In Russia we are allowed to hold two passports. And without no any answer till 2018 will see what are the options to travel by boat, train with a Shnegen visa and my husband with me.
My husband is planning to sent a letter to MP. Here is also tricky ' you need to check very well who is your MP since some of them are completly against immigration and wont move a finger for you.
I also read that when you are going with them into court - they avoid the paperwork and give you the FP almost immediately.
I will keep sharing my thoughts here.. and news.. One head is good - two or more are better!

Regarding your quiery is a different sonario is because as your passport is in UK BA and your application is under consideration the thing is your need to understand is how you gonna get new passport or let say if you got new passport and you arrive at the UK airport when they goona put in computer it will comes up the your passport is with Uk Ba all you need to bear in your mind but still as I this is solely my point of view as I’m not advising (But need to take extra care .......)That’s all I can say ....but if you withdraw your application then you can travel to Uk and you will be free to made application for residence card inside the Uk without any problem

I was actually thinking of withdrawing my application or in the case of refusal, to travel to the UK by plain and applying for Residence Card. But I'm not sure if they let people on the plain without the FP even though they don't need a visa to enter the UK.
Another question is what is the difference if applying for Residence Card holding a FP or without one.
I think they should issue a FP on the border passing if all the documents are alright. Does someone know something about that? Why do people go by ground and get the FP and not the airport? There should apply the same rules on border passing.

Look what I found:

"5.3. Procedures when no EEA family permit or residence card is held
5.3.1. Non-EEA nationals seeking admission as family members of EEA nationals who
are unable to produce a valid passport, family permit, or residence card
On occasions when a third country national seeks admission at port as the family member of
an EEA national but does not hold a valid passport or an EEA family permit or a residence
card ports will need to assess whether or not they qualify for admission under the EEA
Regulations.
Family members are defined in paragraph 5.5 and family members who have retained the
right of residence in paragraph 5.6.
Ports should take particular note of the guidance on those who seek admission under the
extended family member provisions as dependant relatives and as a family member of an
EEA national with whom they have a “durable relationship” (unmarried partner); the relative
criteria in part 8 of the immigration rules (excluding the requirement for entry clearance)
should be used to make a decision on whether or not to admit under the EEA Regulations.
Unlike immediate family members the EEA Regulations allow for an “extensive examination
of the personal circumstances” of those who fall within the extended family member
provisions.
Ports should also take note of the initial right of residence that EEA nationals and their family
members have during the first three months of their time in the UK. Please refer to
paragraphs 4.5 and 6.1.
5.3.2. Seeking admission at port
EEA applicants at port should be treated as persons seeking admission unless explicit
reference is made to applying for a residence card, in which case please refer to paragraph
5.3.3. Admission cases will fall into one of the following categories:
i) produces satisfactory evidence on arrival
The person arrives to accompany or join an EEA national and is carrying satisfactory
evidence of his/her identity and that he/she is the family member of the EEA national and
that the EEA national has a right to reside in the UK. The person should be admitted for 6
months on a Code 1A. Complete landing card.

ii) is unable to produce satisfactory evidence on arrival
Regulation 11(4) states that when a non-EEA family member does not produce on arrival a
valid passport along with an EEA family permit or residence card or permanent residence
card he should be given “every reasonable opportunity” to prove by other means that he is
the family member of an EEA national, a family member who has retained the right of
residence or a person with a permanent right of residence. In other words a person claiming
to have a right of admission under the EEA Regulations should not automatically be refused
admission as a result of being unable to produce a valid passport and either a family permit,
a residence card or permanent residence card.
In such circumstances a judgement will have to be made on how long the person is given to
provide evidence, taking into account the person’s circumstances. As a guide, it is
reasonable to expect a person making a credible claim to be a family member to be able to
provide evidence and for port to be able to make a decision on the case within one week of
first arriving. Ports should consider refusing admission after this unless the particular
circumstances of the case merit longer term inquiries. If it is decided that port will grant
admission the person should be admitted for 6 months on a Code 1A. Complete landing
card.


iii) submits an application for admission post arrival
The person has arrived seeking entry in another capacity and whilst on TA seeks admission
under the EEA Regulations. In such circumstances the same guidance as in ii) above should
be followed except that a decision within one week of the application under the EEA
Regulations is a reasonable expectation.
If the person has been on TA for more than 3 months any decision to refuse will attract an
in-country right of appeal (see paragraph 8.1). "

I applied on 15 September 17. Still waiting. Called the paid service last Friday and they said I should wait for 15 working days. Yesterday I got this email.
