Tier 2 CoS expiry date

Post by Kaz14 » Wed Dec 13, 2017 5:27 pm

Hi Everyone - Need advice please!

I am currently on a Tier 2 General visa. The current CoS is issued till 07th Jan 2018 and the T2 visa expires on 21st January 2018. (which is 14 days after my current CoS expiry).
I am working for the same organisation and going to extend my T2 G visa again.
My questions are:
1) Do I need to extend my T2 G visa before the expiry of my current CoS (07/01/2018)? Of-course I will apply before the expiry of my visa (21/01/2018).
2) If I apply after the expiry of my current CoS, will it break the continuity of my T2 leave or will it affect my future applications in any way?
3) Should the start date of new CoS be after the expiry of current leave (21/01/2017).
According to Tier 2 policy guideline (https://www.gov.uk/government/uploads/s ... 5-2017.pdf)
“38.23 “When you assign a CoS to extend a migrant’s leave in the same tier and category, the start date on the CoS should be the day after their current leave expires.”

Note: If I apply to extend my visa on 20/01/2017 (1 day before my visa expiry) it will help me to complete 5 years. Otherwise I need to extend my visa again to complete 5 years on T2.
Your help will be greatly appreciated.
Thanks

You should apply before the COS expires. Ideally you should apply asap.
2) If I apply after the expiry of my current CoS, will it break the continuity of my T2 leave or will it affect my future applications in any way?
If you apply after COS is expired your T2 extension will be refused. Since your current T2 is valid until only 21st Jan 2018 I'd apply asap.
Yes it should be ideally but you can apply anytime you don't have to / should not wait until your current T2 expires.
Note: If I apply to extend my visa on 20/01/2017 (1 day before my visa expiry) it will help me to complete 5 years. Otherwise I need to extend my visa again to complete 5 years on T2.
You cannot as your COS expires on 7th Jan 2018. You do realize if you apply after this day and if T2 extension refused you'll have only 14 days to find another sponsor.

When was the first T2 issues to you ? The BRP issue date

@makky86 - Thank you for your help.

You cannot as your COS expires on 7th Jan 2018. You do realize if you apply after this day and if T2 extension refused you'll have only 14 days to find another sponsor.

If I apply before the expiry of my leave but after the expiry of my current CoS - even than they will refuse my application. My organisation is taking time to issue new CoS and i am bit concern that I might receive it after the expiry of my current CoS

My organisation is giving me CoS for 3 years, whereas If I they provide me 3 years and 2 months of CoS then my 5 years will be completed. there is only 65 days gaps. But they are not supporting me to have 3 years and 2 month. though My job is permanent.....

Any advise please

The current CoS is issued till 07th Jan 2018
I think you are confused. The CoS you mention above, is this the CoS you used to apply for your CURRENT visa which is expiring on 21st January 2018?

If yes, it has no relevance to your extension application. You MUST however submit a new application with a new valid CoS before your current visa expires.
