Hello Every one i need some guidence and advice please

some background
i came into this country in 2011 with my 9 year old son and claimend asylum because my younger son who was 7 year old got killed i was being attacked three times. i had hundreds evidences but Ho just decided not to believe me meanwhile in 2012 i started relation with a British girl which is ongoing till today other side my Ho case was still in fresh claim on family life . now the problem is my partner works full time and having rented house from a housing associastion i tried to move with my partner but her housing comp said your partner cant move in cos of new laws by home office which stats anyone who has no right to rent in this country cant move to this type of accomodation . and other hand me and my son living in home office NASS accomodation and nass dont allowe her to move with us coz she works full time and earned 23k a year and btw she just lived in next street . we provied every kind of letters like school letter that my partner dropped my son to school attended school meetings GP letter that she is taking care of my son my neighbours that she stayed every day here and a MP him self gave a letter that he knows personlay me and my partner since 5 years they are in relation but ho just has standerd line that provide us a bill . when their own law wont allow us to live together . Now she is pregnant 9 month we having baby anytime i will be father of a British child and other hand father of child who spent his 6 and half year in this country just passed his GCSE

we provide everything as partner but no hope now some one adviced me apply on british childs base but i have still no hope coz Ho dont accept anyting and im saying that on the bases of my past experience, anyone here can guide me what to do ? and please accept my appologied if my English were poor

This is a real dilemma for you !

However, if she is working full time and earning 23k pa so how comes / or why she has to live in a house provided by a housing association?
Is she getting any housing benefits !!!

If she (along with you) gets a house from a private landlord, I don't think there would be any issues, or since you have an application pending with the Home Office, you should be able to co-rent a house, you don't have to live in a NASS accommodation.

In any case, home office should provide you a letter or any landlord or housing association should be able to check your status (i.e. application pending) therefore you should be able to rent.

Bring this to your MPs attention and ask him to write to home office and to the housing association and urge / press them to resolve the issue ASAP.

Thanks Kashif She owned a house which belong from a pvt housing association shent taking any benifits from GOVT secondly MP sent a letter to home office to that what kinda law is this where she need her partner in this situation and she cant when she is paying off for every thing but HO didnt reply on this
and we requested home office to provide us a confirmation that im not Illegal in this country so we the housing association can grant us to live thats what housing association told us to bring a letter from ho but they didnt provide us ....

From your description, you are currently illegal/an overstayer in the UK.

When you arrived in the UK, what visa did you have/were issued? Have you been issued (not just applied for) with any leave/visa by the Home Office? If so, what are the dates?

Have they dealt with the fresh claim yet.

The unborn child will not be considered at this present moment. However fresh claim may well succeed. The difficulty is the lack of 7 years residence for the GCSE child.

Hi Thanks Simon thanks for reply . well in that case if i were illegal why HO providng me Free Accomodation and weekly benefits ? when i applied asylum in 2011 HO issued me Temporary Leave which is valid till today

and when i requested ho to provide me confirmation that i can live in my partners house they didnt say i cant move they just ignored that request

Fresh Claim Decision is pending yet and yes i agreed Unborn Child will not be considered at this stage and baby due anything this week or maybe next week . i ve got 5 months left to complete 7 years of child in UK at this stage i want to know if i apply flr fp when new baby born ? or wait till 7 years completed ?

go for fresh claim and don't go for FLR and fresh claim taking less time

Let me tell you my situation first I came here in 2012 as a student my visa got expired and I start a relationship with my partner in 2015 we had a child in 2016 and I applied flr fp application as father of British child I provide them all documents evidence everything but we are not living together I’m living aunty house and she is living on her own I see my baby daily basis even my partner gave her letter to ho I see my baby daily basis any chance of getting visa please any advice thanks

Hi Casa just an update my child was born in August 2017 and i sent his birth certificate and British passport as well to Home office because my fresh claim on pvt life was already with them but its been 5 months now no answer. Want to know do i need to submit a flr fp With a fee beause someone told me they not going to give decision if you dont submit prop application

any Idea on this ? please

Hi Every one

I Need some advise ive got British Child from which is now 4 month old ive sent my application before he was born on the basis of family life which was previously refused by Home office Because they said we dont have Valid Documents to prove we are partners now ive got a British Child and recently i have a Court order to see my child on Regular basis because me and partner not living together. my Question is do i have a Valid groud to apply on Child basis ?
since 2011 i was an Asylum seeker never been illegal in UK Came with a Son who is 16 now and he will have 7 year in this country as well march 2018

Please Advise on this subject

Yes it is possible. You need to show you a playing a role in the life of the child and intend to continue doing so.

Has a British passport been applied for?

We are seperated now thats why ive got Court order to Contact my child on daily basis
