Divorce with eea nation after getting PR

Post by Bilal ashraf » Wed Dec 20, 2017 12:27 am

7 10:13 pm

I am an Indian national
who got married to a french national in June 2010, and in 2011 ive got my 5 years residence visa after completed 5 years of marriage last year i applied for PR and ive got PR this year in Aug and now unfortunately things are going wrong and we are going to apply for a divorce. I assumed that PR means I no longer depend on my wife. RIGHT ? however each time I cross the UK border I get asked same.
Who is your family member ? Is your wife still live with you and all that. This is very frustrating so my question is what will happens after we have divorced?? Will they cancel my PR? Will I be unable to apply for a citizenship? Just because we are not in relationship anymore ? Can you please explain me about this please.
Many thanks

You are not dependent anymore and can go ahead with divorce... you can apply for citizenship after holding PR status for one year...

I have PR not ILR. Is there any difference between PR and ILR ? And second thing is. Whenever I go through to Uk border even after getting PR. They still asking me, how did you get your PR, are you still live with your wife all these question. If I’m no longer depend on her then why they ask these question.
MANY THANKS

No, just different routes to get each one. Both are settled status.

Have you got a permanent residence as a family member of eu citizen? If it is residence card for a family member then does it makes any difference? Do u still depend on a family member or not?

So even if it was given because you are a family member they can't revoke it? And it will be still valid even if you are not a family member any longer or don't live together? They ask these questions all the time when I cross the border. Have u ever told them that u are divorsed?
