I have moved your post to your own topic as you had tagged your question onto an inactive thread which is over 3 years old! You haven't said whether your husband is an EEA national. You need to confirm this before anyone can advise you.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

What is the UK immigration status of your spouse? Is s/he a British citizen, an EEA citizen or here on another visa?

Except if you are married to an EEA citizen, mere marriage does not give you the right to reside in the UK and you still remain an overstayer.
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.
